  1  2                        RESOURCE CENTERS
  1  3    Section 1.  Section 218.1, subsections 1 and 2, Code 1999,
  1  4 are amended to read as follows:
  1  5    1.  Glenwood state hospital-school resource center.
  1  6    2.  Woodward state hospital-school resource center.
  1  7    Sec. 2.  Section 222.1, Code 1999, is amended to read as
  1  8 follows:
  1  9    222.1  PURPOSE OF STATE SCHOOLS RESOURCE CENTERS.
  1 10    1.  The Glenwood state hospital-school resource center and
  1 11 the Woodward state hospital-school resource center are
  1 12 established and shall be maintained as the state's regional
  1 13 resource centers for the purpose of providing treatment,
  1 14 training, instruction, care, habilitation, and support of
  1 15 persons with mental retardation or other disabilities in this
  1 16 state, and providing facilities, services, and other support
  1 17 to the communities located in the region being served by a
  1 18 state hospital-school resource center.  In addition, the state
  1 19 hospital-schools resource centers are encouraged to serve as a
  1 20 training resource for community-based program staff, medical
  1 21 students, and other participants in professional education
  1 22 programs.  A hospital-school resource center may request the
  1 23 approval of the council on human services to change the name
  1 24 of the institution resource center for use in communication
  1 25 with the public, in signage, and in other forms of
  1 26 communication.
  1 27    2.  A special mental retardation unit may be maintained at
  1 28 one of the state mental health institutes for the purposes set
  1 29 forth in sections 222.88 to 222.91.
  1 30    Sec. 3.  Section 222.2, subsection 3, Code 1999, is amended
  1 31 by striking the subsection.
  1 32    Sec. 4.  Section 222.2, Code 1999, is amended by adding the
  1 33 following new subsection:
  1 34    NEW SUBSECTION.  6A.  "State resource centers" or "resource
  1 35 centers" means the Glenwood state resource center and the
  2  1 Woodward state resource center.
  2  2    Sec. 5.  Section 222.2, subsection 7, Code 1999, is amended
  2  3 to read as follows:
  2  4    7.  "Superintendents" means the superintendents of the
  2  5 state hospital-schools resource centers.
  2  6    Sec. 6.  AMENDMENTS TO TERMS "HOSPITAL-SCHOOL" AND
  2  7 "HOSPITAL-SCHOOLS" – DIRECTIVE TO CODE EDITOR.
  2  8    1.  Sections 218.3, 218.92, 222.5, 222.6, 222.7, 222.9,
  2  9 222.12, 222.13, 222.15, 222.31, 222.36, 222.37, 222.38,
  2 10 222.39, 222.41, 222.42, 222.43, 222.44, 222.45, 222.51,
  2 11 222.59, 222.60, 222.61, 222.62, 222.65, 222.66, 222.67,
  2 12 222.68, 222.69, 222.70, 222.72, 222.73, 222.77, 222.78,
  2 13 222.83, 222.84, 222.85, 222.86, 222.87, 227.6, 249A.11, and
  2 14 252.16, Code 1999, are amended by striking from the sections
  2 15 the word "hospital-school" and inserting in lieu thereof the
  2 16 words "resource center".
  2 17    2.  Sections 23A.2, 222.13A, and 227.2, Code Supplement
  2 18 1999, are amended by striking from the sections the word
  2 19 "hospital-school" and inserting in lieu thereof the words
  2 20 "resource center".
  2 21    3.  Sections 135B.9, 218.9, 218.78, 222.3, 222.4, 222.6,
  2 22 222.7, 222.8, 222.11, and 222.90, Code 1999, are amended by
  2 23 striking from the sections the word "hospital-schools" and
  2 24 inserting in lieu thereof the words "resource centers".
  2 25    4.  Sections 225C.4, 225C.6, 227.2, and 331.440A, Code
  2 26 Supplement 1999, are amended by striking from the sections the
  2 27 word "hospital-schools" and inserting in lieu thereof the
  2 28 words "resource centers".
  2 29    5.  The Code editor shall substitute the words "resource
  2 30 center" for the word "hospital-school" anywhere in the Code of
  2 31 Iowa or in any enactment to be codified if there appears to be
  2 32 no doubt as to the intent to refer to the Glenwood resource
  2 33 center or Woodward resource center under the authority of the
  2 34 department of human services.
  2 35    6.  The Code editor shall substitute the words "resource
  3  1 centers" for the word "hospital-schools" anywhere in the Code
  3  2 of Iowa or in any enactment to be codified if there appears to
  3  3 be no doubt as to the intent to refer to the Glenwood resource
  3  4 center and Woodward resource center under the authority of the
  3  5 department of human services.  
  3  6                           DIVISION II
  3  7             SERVICE INFORMATION – OTHER PROVISIONS
  3  8    Sec. 7.  Section 225C.20, Code 1999, is amended to read as
  3  9 follows:
  3 10    225C.20  RESPONSIBILITIES OF COUNTIES FOR INDIVIDUAL CASE
  3 11 MANAGEMENT SERVICES.
  3 12    Individual case management services funded under medical
  3 13 assistance shall be provided by the department except when a
  3 14 county or a consortium of counties contracts with the
  3 15 department to provide the services.  A county or consortium of
  3 16 counties may contract to be the provider at any time and the
  3 17 department shall agree to the contract so long as the contract
  3 18 meets the standards for case management adopted by the
  3 19 department.  The county or consortium of counties may
  3 20 subcontract for the provision of case management services so
  3 21 long as the subcontract meets the same standards.  A county
  3 22 board of supervisors may change the provider of individual
  3 23 case management services at any time.  If the current or
  3 24 proposed contract is with the department, the county board of
  3 25 supervisors shall provide written notification of a proposed
  3 26 change to the department on or before August 15 and written
  3 27 notification of an approved change on or before November 15 in
  3 28 the fiscal year which precedes the fiscal year in which the
  3 29 change at least ninety days before the date the change will
  3 30 take effect.
  3 31    Sec. 8.  Section 331.440A, subsection 1, paragraph b, Code
  3 32 Supplement 1999, is amended to read as follows:
  3 33    b.  "Pilot project areas" means the pilot project created
  3 34 under this section involving the three-county county or
  3 35 multicounty single entry point process administrative areas
  4  1 designated in accordance with this section.
  4  2    Sec. 9.  Section 331.440A, subsection 3, Code Supplement
  4  3 1999, is amended to read as follows:
  4  4    3.  PROJECT ESTABLISHED.  The department of human services
  4  5 shall establish a pilot project for decategorizing the public
  4  6 funding for adult mental health, mental retardation, and
  4  7 developmental disabilities services in accordance with this
  4  8 section.  The pilot project shall include the three-county
  4  9 single entry point process administrative areas designated for
  4 10 decategorization planning under 1997 Iowa Acts, chapter 169,
  4 11 section 13, Washington county, and Webster county.  Under the
  4 12 pilot project, a projected funding amount for a fiscal year
  4 13 shall be developed for each of the three administrative pilot
  4 14 project areas, from the funding sources designated in this
  4 15 section.  The projected funding amount for a fiscal year,
  4 16 manner of payment, and other provisions of the pilot project
  4 17 shall be delineated in contracts between the department and
  4 18 the counties involved in the pilot project.
  4 19    Sec. 10.  Section 331.440A, subsection 7, paragraph a,
  4 20 subparagraph (1), Code Supplement 1999, is amended to read as
  4 21 follows:
  4 22    (1)  At least one service consumer, one service provider,
  4 23 and one county supervisor from each of the three pilot project
  4 24 areas, designated by the governor.
  4 25    Sec. 11.  INFORMATION.  The department of human services
  4 26 shall develop data that tracks the county of residence for all
  4 27 individuals who received mental health or developmental
  4 28 disabilities services funded by medical assistance and for
  4 29 which the nonfederal share was paid by a county.  In addition,
  4 30 the department shall provide this data for individuals who
  4 31 received such services and for which the state paid the
  4 32 nonfederal share.  Initially, the data shall be reported for
  4 33 all or part, as available, of fiscal years 1998-1999 and 1999-
  4 34 2000.  The aggregate data, along with other pertinent
  4 35 information, shall be submitted as soon as is practicable to
  5  1 the governor, general assembly, and any task force created by
  5  2 the legislative council to study mental health and
  5  3 developmental disabilities services.
  5  4    Sec. 12.  EFFECTIVE DATE.  This division of this Act, being
  5  5 deemed of immediate importance, takes effect upon enactment.  
  5  6                           EXPLANATION
  5  7    This bill relates mental health and developmental
  5  8 disabilities services funding and administrative provisions.
  5  9    Division I of the bill changes Code references from state
  5 10 "hospital-schools" to Glenwood and Woodward state "resource
  5 11 centers".
  5 12    The reference changes are applied in Code section 218.1 and
  5 13 222.1, relating to the list of the department's institutions,
  5 14 and in Code section 222.2, relating to assignment of
  5 15 administrative responsibilities for the two institutions.
  5 16    Code section 222.2, relating to the definitions used in
  5 17 Code chapter 222, is amended to strike the current law's
  5 18 definition of the state hospital-schools and replace it with a
  5 19 new definition of the resource centers.  This change is also
  5 20 applied to the definition of the term "superintendents".
  5 21    An alternative form of bill drafting is utilized to change
  5 22 the references from "hospital-school" to "resource center", in
  5 23 both singular and plural forms, in specified sections of the
  5 24 1999 Code and Code Supplement.  In addition, the Code editor
  5 25 is directed to apply this change throughout the Code of Iowa,
  5 26 including new enactments to be codified.
  5 27    Division II contains various provisions relating to mental
  5 28 health and developmental disabilities services.
  5 29    Code section 225C.20, relating to responsibilities of
  5 30 counties for provision of individual case management services
  5 31 under the medical assistance program, is amended.  Under
  5 32 current law, a county may change the provider of services at
  5 33 any time but if the provider is the department, the county
  5 34 must notify the department at specified dates during the
  5 35 fiscal year preceding the fiscal year in which the change
  6  1 would apply.  Under the bill, if the service provider is the
  6  2 department, a county must notify the department at least 90
  6  3 days in advance of the date the change would take effect.
  6  4    Code section 331.440A, relating to the adult
  6  5 decategorization of funding pilot project for county-
  6  6 adminstered mental health and developmental disabilities
  6  7 services, is amended.  Under the bill, Washington and Webster
  6  8 counties are added to the three counties currently authorized
  6  9 for the pilot project.
  6 10    In addition, division II of the bill directs the department
  6 11 of human services to develop certain tracking data for persons
  6 12 who received mental health or developmental disabilities
  6 13 services funded under the medical assistance program.  This
  6 14 division takes effect upon enactment.
