  1  1    Section 1.  NEW SECTION.  80.40  GUN SAFETY EDUCATION
  1  2 PROGRAM.
  1  3    A gun safety education program is established within the
  1  4 department of public safety.  The department of public safety
  1  5 shall develop and implement the program throughout the state.
  1  6 The general safety and welfare of the state is related to
  1  7 educating the citizens of this state about gun safety and a
  1  8 vital public purpose is served by the creation and
  1  9 implementation of a gun safety education program.  The
  1 10 department shall work with local sheriffs in developing the
  1 11 program, and the department or a local sheriff conducting the
  1 12 program may contract with a private organization, or use the
  1 13 services of other agencies, to administer the program.  The
  1 14 gun safety education program is established for the purpose of
  1 15 enhancing existing gun safety programs educating the citizens
  1 16 of this state about gun safety.
  1 17    Sec. 2.  Section 724.9, Code 1999, is amended to read as
  1 18 follows:
  1 19    724.9  FIREARM TRAINING PROGRAM.
  1 20    A training program to qualify persons in the safe use of
  1 21 firearms shall be provided by the issuing officer of permits,
  1 22 as provided in section 724.11.  The commissioner of public
  1 23 safety shall approve the training program, and the county
  1 24 sheriff or the commissioner of public safety conducting the
  1 25 training program within their respective jurisdictions may
  1 26 contract with a private organization or use the services of
  1 27 other agencies, or may use a combination of the two, to
  1 28 provide such training.  Any person eligible to be issued a
  1 29 permit to carry weapons or a permit to acquire a pistol or
  1 30 revolver, may enroll in such course a program.  A fee
  1 31 sufficient to cover the cost of the program may be charged
  1 32 each person attending.  Certificates of completion, on a form
  1 33 prescribed and published by the commissioner of public safety,
  1 34 shall be issued to each person who successfully completes the
  1 35 program.  No A person shall not be issued either a
  2  1 professional or nonprofessional permit to carry weapons, or a
  2  2 permit to acquire a pistol or revolver unless the person has
  2  3 received a certificate of completion or is a certified peace
  2  4 or reserve peace officer.  No A peace officer or correctional
  2  5 officer, except a certified peace officer, shall not go armed
  2  6 with a pistol or revolver unless the officer has received a
  2  7 certificate of completion, provided that this requirement
  2  8 shall not apply to persons who are employed in this state as
  2  9 peace officers on January 1, 1978 until July 1, 1978, or to
  2 10 peace officers of other jurisdictions exercising their legal
  2 11 duties within this state.
  2 12    Sec. 3.  Section 724.11, Code 1999, is amended to read as
  2 13 follows:
  2 14    724.11  ISSUANCE OF PERMIT TO CARRY WEAPONS.
  2 15    Applications for permits to carry weapons shall be made to
  2 16 the sheriff of the county in which the applicant resides.
  2 17 Applications from persons who are nonresidents of the state,
  2 18 or whose need to go armed arises out of employment by the
  2 19 state, shall be made to the commissioner of public safety.  In
  2 20 either case, the issuance of the permit shall be by and at the
  2 21 discretion of the sheriff or commissioner, who shall, before
  2 22 issuing the permit, determine that the requirements of
  2 23 sections 724.6 to 724.10 have been satisfied.  However, the
  2 24 training program requirements in section 724.9 may be waived
  2 25 for renewal permits.  The issuing officer shall collect a fee
  2 26 of ten twenty-five dollars, except from a duly appointed peace
  2 27 officer, reserve police officer, or correctional officer, for
  2 28 each new, duplicate, or renewal permit issued.  Renewal
  2 29 permits or duplicate permits shall be issued for a fee of five
  2 30 dollars.  The issuing officer shall notify the commissioner of
  2 31 public safety of the issuance of any permit at least monthly
  2 32 and forward to the commissioner an amount equal to two dollars
  2 33 twenty percent of the fee collected for each permit issued and
  2 34 one dollar for each renewal or duplicate permit issued.  All
  2 35 such fees received by the commissioner shall be paid to the
  3  1 treasurer of state and deposited in the operating account of
  3  2 the department of public safety the general fund of the state
  3  3 and the moneys from the fees are appropriated to the
  3  4 department of public safety to offset the cost of
  3  5 administering this chapter.  Any unspent balance as of June 30
  3  6 of each year shall revert to the general fund as provided by
  3  7 section 8.33.
  3  8    Sec. 4.  Section 724.19, Code 1999, is amended to read as
  3  9 follows:
  3 10    724.19  ISSUANCE OF ANNUAL PERMIT TO ACQUIRE.
  3 11    The annual permit to acquire pistols or revolvers shall be
  3 12 issued to the applicant immediately upon completion of the
  3 13 application unless the applicant is disqualified under the
  3 14 provisions of section 724.15 and shall be on a form prescribed
  3 15 and published by the commissioner of public safety.  The
  3 16 permit shall contain the name of the permittee, the social
  3 17 security number of the permittee, the residence of the
  3 18 permittee, and the effective date of the permit.  The issuing
  3 19 officer shall collect a fee of twenty-five dollars for each
  3 20 permit issued.  The issuing officer shall notify the
  3 21 commissioner of public safety of the issuance of any permit at
  3 22 least monthly and forward to the commissioner an amount equal
  3 23 to twenty percent of the fee collected for each permit issued.
  3 24 All such fees received by the commissioner shall be deposited
  3 25 in the general fund of the state and the moneys from the fees
  3 26 are appropriated to the department of public safety to offset
  3 27 the cost of administering this chapter.
  3 28    Sec. 5.  CONTINGENT EFFECTIVE DATE.  This Act takes effect
  3 29 July 1, 2000, only if the fee increases in sections 3 and 4 of
  3 30 this Act, amending sections 724.11 and 724.19, are enacted.  
  3 31                           EXPLANATION
  3 32    This bill establishes a gun safety education program to be
  3 33 administered throughout the state.
  3 34    The bill provides that the department of public safety
  3 35 shall work with local county sheriffs in developing the
  4  1 program.  The bill provides that the program shall enhance
  4  2 existing gun safety programs educating people about gun
  4  3 safety.
  4  4    The bill also provides that the commissioner of public
  4  5 safety shall approve any gun safety education program before
  4  6 the program is implemented.
  4  7    The bill provides that any person eligible for a permit to
  4  8 acquire a pistol or revolver may enroll in a firearm safety
  4  9 training program before obtaining a permit.  The bill also
  4 10 provides that a permit shall not be issued to carry weapons or
  4 11 acquire a pistol or revolver until the person other than a
  4 12 peace or reserve peace officer has completed the program.
  4 13    Code section 724.11 is amended to increase the fee for
  4 14 applications to carry concealed weapons from $10 for an
  4 15 original application and $5 for a renewal or duplicate permit
  4 16 to $25 for all applications.  Of each $25 fee, 80 percent of
  4 17 the fee collected is to be retained by the sheriff's office
  4 18 and 20 percent of the fee collected is to be sent and is
  4 19 appropriated to the department of public safety.
  4 20    Code section 724.19 is amended to establish a fee of $25
  4 21 for a permit to acquire a pistol or revolver.  Currently,
  4 22 there is no fee.  For each $25 fee collected, the sheriff
  4 23 would retain 80 percent of the fee collected to process the
  4 24 application and the department of public safety would receive
  4 25 20 percent of the fee collected by the sheriff's office as an
  4 26 appropriation to administer Code chapter 724.
  4 27    The bill takes effect July 1, 2000, but only if the fee
  4 28 increases in the bill are enacted.
