PAG LIN 1 1 Section 1. Section 360.9, Code 1999, is amended by 1 2 striking the section and inserting in lieu thereof the 1 3 following: 1 4 360.9 DISPOSAL OF INTEREST IN REAL PROPERTY. 1 5 1. In disposing of any interest in real property including 1 6 improvements on the real property, that is situated wholly 1 7 outside of a city, is owned by a township, used for township 1 8 purposes, and is no longer necessary for township purposes, by 1 9 sale or exchange, by lease for a term of more than three 1 10 years, or by gift, the township shall follow the following 1 11 procedures, except as otherwise provided by state law: 1 12 a. The township trustees shall set forth their proposal in 1 13 a resolution and shall publish notice of the time and place of 1 14 a public hearing on the proposal at least once, not less than 1 15 four nor more than twenty days before the date of the hearing, 1 16 in one or more newspapers which meet the requirements of 1 17 section 618.14. 1 18 b. After the public hearing, the township trustees may 1 19 make a final determination on the proposal by resolution. 1 20 2. The township trustees shall not dispose of real 1 21 property by gift except for a public purpose, as determined by 1 22 the township trustees, in accordance with other state law. 1 23 However, the township trustees may dispose of real property 1 24 for use in an Iowa homesteading program under section 16.14 1 25 for a nominal consideration. 1 26 EXPLANATION 1 27 This bill provides that a township disposing of an interest 1 28 in real property shall first hold a public hearing on the 1 29 proposed transaction, and then resolve the issue by resolution 1 30 of the township trustees. This procedure is similar to the 1 31 procedures for disposal of interests in real estate by cities, 1 32 under Code section 364.7, and counties, under Code section 1 33 331.361. The bill also places a limitation on disposal of the 1 34 interest by gift, similar to those other Code sections. 1 35 Current Code section 360.9 requires that before a township 2 1 may dispose of property that is no longer needed, the real 2 2 estate interest either reverts to the present owner of the 2 3 land from which the tract was taken, if the owner pays the 2 4 value of the property, or the township may sell the property 2 5 at public auction. The current Code section also provides for 2 6 other related procedures and limitations on real estate 2 7 transfers by the township. 2 8 LSB 6651YC 78 2 9 jj/cf/24
