PAG LIN 1 1 Section 1. NEW SECTION. 15.221 IOWA LEWIS AND CLARK 1 2 BICENTENNIAL COMMISSION. 1 3 1. The Iowa Lewis and Clark bicentennial commission is 1 4 established in the department of economic development for 1 5 purposes of coordinating and promoting the observance of this 1 6 state's bicentennial commemoration of the Lewis and Clark 1 7 expedition. The commission shall be organized and shall 1 8 operate as a nonprofit corporation within this state in 1 9 accordance with chapter 504A. 1 10 2. The commission shall be composed of seven members 1 11 consisting of all of the following: 1 12 a. The director of the department of cultural affairs or 1 13 the director's designee. 1 14 b. The administrator of the division of tourism within the 1 15 department of economic development, or the administrator's 1 16 designee. 1 17 c. The administrator of the parks and preserves division 1 18 within the department of natural resources, or the 1 19 administrator's designee. 1 20 d. The administrator of the historical division within the 1 21 department of cultural affairs, or the administrator's 1 22 designee. 1 23 e. The remaining three members shall be appointed by the 1 24 governor, subject to confirmation by the senate. The members 1 25 appointed by the governor shall have an interest or expertise 1 26 in the history of the Lewis and Clark expedition. At least 1 27 two of the members appointed by the governor shall be members 1 28 of an Indian tribe encountered by the Lewis and Clark 1 29 expedition. 1 30 3. The members appointed by the governor shall be 1 31 appointed in compliance with sections 69.16 and 69.16A and 1 32 shall serve three-year terms beginning and ending as provided 1 33 by section 69.19. Members appointed by the governor may be 1 34 reappointed. 1 35 4. The commission shall annually elect a chairperson and 2 1 vice chairperson from the members of the commission. 2 2 5. Commission members shall serve without compensation, 2 3 but shall be reimbursed for actual and necessary expenses. 2 4 Sec. 2. NEW SECTION. 15.222 POWERS. 2 5 The commission may do all of the following: 2 6 1. Cooperate with other entities conducting national, 2 7 regional, state, or local events promoting the bicentennial. 2 8 2. Plan, assist, coordinate, or conduct bicentennial 2 9 events. 2 10 3. Engage in fund-raising activities, including revenue- 2 11 earning enterprises and the solicitation of grants, gifts, and 2 12 donations. 2 13 4. Promote public education concerning the Lewis and Clark 2 14 expedition. 2 15 5. Coordinate interagency participation in the observance 2 16 and work with appropriate federal entities such as the 2 17 national park service, the United States forest service, and 2 18 the United States army. 2 19 6. Appoint various local and regional advisory committees. 2 20 7. Perform any other related duties. 2 21 Sec. 3. NEW SECTION. 15.223 IOWA LEWIS AND CLARK 2 22 BICENTENNIAL FUND. 2 23 An Iowa Lewis and Clark bicentennial fund is created as a 2 24 separate fund in the state treasury under the control of the 2 25 commission. The assets of the fund shall be used by the 2 26 commission only for carrying out the purposes of this part. 2 27 The fund shall consist of any moneys appropriated by the 2 28 general assembly for that purpose and any other moneys 2 29 available to and obtained or accepted by the commission for 2 30 placement in the fund. Notwithstanding section 8.33, moneys 2 31 in the Iowa Lewis and Clark bicentennial fund at the end of 2 32 each fiscal year shall not revert to any other fund but shall 2 33 remain in the Lewis and Clark bicentennial fund for 2 34 expenditure for subsequent fiscal years. 2 35 Sec. 4. NEW SECTION. 15.224 RULES. 3 1 The department, in cooperation with the commission, may 3 2 adopt administrative rules pursuant to chapter 17A necessary 3 3 to accomplish the purpose of the commission. 3 4 Sec. 5. NEW SECTION. 15.225 TERMINATION. 3 5 The Iowa Lewis and Clark bicentennial commission shall 3 6 dissolve by December 31, 2007. 3 7 Sec. 6. EFFECTIVE DATE. This Act, being deemed of 3 8 immediate importance, takes effect upon enactment. 3 9 EXPLANATION 3 10 This bill creates an Iowa Lewis and Clark bicentennial 3 11 commission and fund. 3 12 The bill establishes an Iowa Lewis and Clark bicentennial 3 13 commission within the department of economic development which 3 14 shall be chartered and operated as a nonprofit corporation for 3 15 purposes of coordinating and promoting the observance of this 3 16 state's bicentennial commemoration of the Lewis and Clark 3 17 expedition. The bill provides that the commission shall be 3 18 composed of seven members consisting of the director of the 3 19 department of cultural affairs, the division administrator of 3 20 the division of tourism within the department of economic 3 21 development, the division administrator of the parks, 3 22 recreation, and preserves division within the department of 3 23 natural resources, and the division administrator of the 3 24 historical division within the department of cultural affairs. 3 25 The bill provides that the remaining three members shall be 3 26 appointed by the governor, subject to confirmation by the 3 27 senate. The bill provides that the members appointed by the 3 28 governor shall have an interest or expertise in the history of 3 29 the Lewis and Clark expedition and at least two of the members 3 30 shall be members of an Indian tribe encountered by the Lewis 3 31 and Clark expedition. 3 32 The bill provides that the commission may cooperate with 3 33 national, regional, state, and local events promoting the 3 34 bicentennial; plan, assist, coordinate, or conduct 3 35 bicentennial events; engage in fund-raising activities, 4 1 including revenue-earning enterprises and the solicitation of 4 2 grants, gifts, and donations; promote public education 4 3 concerning the Lewis and Clark expedition; coordinate 4 4 interagency participation in the observation and work with 4 5 appropriate federal entities such as the national park 4 6 service, the United States forest service, and the United 4 7 States army; appoint various local and regional advisory 4 8 committees; and perform any other related duties. 4 9 The bill provides that an Iowa Lewis and Clark bicentennial 4 10 fund is established as a separate fund in the state treasury 4 11 under the control of the commission and that the assets of the 4 12 fund shall be used by the commission for carrying out the 4 13 purposes of the commission. 4 14 The bill provides that the Iowa Lewis and Clark 4 15 bicentennial commission terminates on December 31, 2007. 4 16 The bill takes effect upon enactment. 4 17 LSB 6594HC 78 4 18 tm/cls/14
