  1  1    Section 1.  Section 455B.424, subsections 1 and 5, Code
  1  2 1999, are amended to read as follows:
  1  3    1.  The person who generates hazardous waste or the owner
  1  4 or operator of a hazardous waste disposal facility who
  1  5 transports hazardous wastes off of the site where the
  1  6 hazardous waste was generated or off the disposal facility
  1  7 site shall pay a fee of ten twenty dollars for each ton up to
  1  8 two thousand five hundred tons of hazardous waste transported
  1  9 off the site, excluding the water content of any waste that is
  1 10 transported to another facility under the ownership of the
  1 11 generator for the purposes of waste treatment or recycling.
  1 12    5.  In addition to other fees imposed by this section, a
  1 13 person that is required to obtain a United States
  1 14 environmental protection agency identification number shall
  1 15 pay the following fees:
  1 16    a.  If the person generates more than one thousand
  1 17 kilograms of hazardous waste per month, a fee of two hundred
  1 18 fifty five hundred dollars.
  1 19    b.  If the person generates hazardous waste but does not
  1 20 generate more than one thousand kilograms of hazardous waste
  1 21 per month, a fee of twenty-five fifty dollars.
  1 22    c.  If the person is a transporter of hazardous waste, a
  1 23 fee of twenty-five fifty dollars.
  1 24    d.  If the person operates a hazardous waste treatment,
  1 25 storage, or disposal facility, a fee of twenty-five fifty
  1 26 dollars.  
  1 27                           EXPLANATION
  1 28    This bill amends Code section 455B.424 to increase fees
  1 29 paid by persons required to obtain a United States
  1 30 environmental protection agency identification number and fees
  1 31 paid for generating and transporting hazardous waste.
