  1  1    Section 1.  Section 904.508A, Code 1999, is amended to read
  1  2 as follows:
  1  3    904.508A  INMATE TELEPHONE REBATE FUND REBATES.
  1  4    The department is authorized to establish and maintain an
  1  5 inmate telephone rebate fund in each institution for the
  1  6 deposit of moneys received for inmate telephone rebates.  All
  1  7 funds deposited in this fund shall be used for the benefit of
  1  8 inmates.  The director shall adopt rules providing for the
  1  9 disbursement of moneys from the fund.  All moneys received
  1 10 from inmate telephone rebates shall be credited to the general
  1 11 fund of the state.
  1 12    Sec. 2.  TRANSFER.  Any moneys remaining in an inmate
  1 13 telephone rebate fund maintained in any department of
  1 14 correction's institution on or after July 1, 2000, shall be
  1 15 transferred and credited to the general fund of the state.  
  1 16                           EXPLANATION
  1 17    This bill provides for crediting to the general fund of the
  1 18 state of telephone rebates paid on behalf of inmates of
  1 19 correctional institutions.
  1 20    The bill strikes the provisions in Code section 904.508A
  1 21 that authorize the department of corrections to maintain an
  1 22 inmate telephone rebate fund in each correctional institution
  1 23 and require the moneys to be used for the benefit of inmates.
  1 24    The bill provides that any moneys remaining in any of the
  1 25 funds maintained in the department's institutions on July 1,
  1 26 2000, shall be transferred and credited to the general fund of
  1 27 the state.
