1 4 Sec. 2. Section 598.8, subsection 2, paragraph b,
1 5 subparagraph (3), Code 1999, is amended by striking the
1 6 subparagraph.
1 7 EXPLANATION
1 8 This bill amends Code section 598.8 relating to the
1 9 exceptions to the holding of a hearing in a dissolution of
1 10 marriage action by eliminating the provision that prohibits
1 11 the court from entering a decree of dissolution without a
1 12 hearing if there were children of the marriage for whom
1 13 support might be ordered. The same prohibition is also
1 14 eliminated when a respondent has not entered an appearance or
1 15 filed a motion or pleading in the case and the waiting period
1 16 of 90 days, with exceptions, has expired. The bill would not
1 17 change the provisions that require the parties to certify in
1 18 writing that there has been a breakdown of the marriage
1 19 relationship, to file all documents required by the court, and
1 20 to provide a written agreement settling all of the issues
1 21 involved in the dissolution of marriage.
