1 1 Section 1. Section 802.3, subsection 2, Code 1999, is
1 2 amended to read as follows:
1 3 2. a. An indictment or information for sexual
1 4 exploitation by a counselor or therapist under section 709.15
1 5 shall be found within five years of the date the victim was
1 6 last treated by the counselor or therapist.
1 7 b. An indictment or information for theft of firearms
1 8 constituting a felony or aggravated or serious misdemeanor
1 9 shall be found within five years after the commission of the
1 10 theft.
1 11 Sec. 2. Section 802.4, Code 1999, is amended to read as
1 12 follows:
1 13 802.4 SIMPLE MISDEMEANOR – ORDINANCE.
1 14 1. A prosecution for a simple misdemeanor or violation of
1 15 a municipal or county rule or ordinance shall be commenced
1 16 within one year after its commission, except as specified in
1 17 subsection 2.
1 18 2. A prosecution for a theft of firearms constituting a
1 19 simple misdemeanor shall be commenced within five years after
1 20 its commission.
1 21 EXPLANATION
1 22 This bill changes the statute of limitations for theft of
1 23 firearms constituting a felony or aggravated or serious
1 24 misdemeanor from three to five years, and from one to five
1 25 years for a simple misdemeanor.
1 26 Under Code section 714.2, the theft of firearms exceeding
1 27 $100 in value would constitute a felony or aggravated or
1 28 serious misdemeanor, depending upon the value of the firearms
1 29 in question. The theft of firearms not exceeding $100 in
1 30 value would constitute a simple misdemeanor.
