PAG LIN 1 1 Section 1. Section 257.11, Code 1999, is amended by 1 2 striking the section and inserting in lieu thereof the 1 3 following: 1 4 257.11 SUPPLEMENTARY WEIGHTING. 1 5 1. REGULAR CURRICULUM. Pupils in a regular curriculum 1 6 attending all their classes in the district in which they 1 7 reside, taught by teachers employed by that district, and 1 8 having administrators employed by that district, are assigned 1 9 a weighting of one. 1 10 2. DISTRICT TO DISTRICT SHARING. 1 11 a. In order to provide additional funds for school 1 12 districts which send their resident pupils to another school 1 13 district, which jointly employ and share the services of 1 14 teachers under section 280.15, or which use the services of a 1 15 teacher employed by another school district, a supplementary 1 16 weighting plan for determining enrollment is adopted. 1 17 b. If the school budget review committee certifies to the 1 18 department of management that the shared classes or teachers 1 19 would otherwise not be implemented without the assignment of 1 20 additional weighting, pupils attending classes in another 1 21 school district, attending classes taught by a teacher who is 1 22 employed jointly under section 280.15, or attending classes 1 23 taught by a teacher who is employed by another school 1 24 district, are assigned a weighting, in addition to the 1 25 weighting assigned in subsection 1, of forty-eight hundredths 1 26 of the percentage of the pupil's school day during which the 1 27 pupil attends classes in another district, attends classes 1 28 taught by a teacher who is jointly employed under section 1 29 280.15, or attends classes taught by a teacher who is employed 1 30 by another school district. 1 31 3. DISTRICT TO COMMUNITY COLLEGE SHARING. 1 32 a. In order to provide additional funds for school 1 33 districts which send their resident pupils to a community 1 34 college for classes, a supplementary weighting plan for 1 35 determining enrollment is adopted. 2 1 b. If the school budget review committee certifies to the 2 2 department of management that the class would not otherwise be 2 3 implemented without the assignment of additional weighting, 2 4 pupils attending a community college-offered class or 2 5 attending a class taught by a community college-employed 2 6 teacher are assigned a weighting, in addition to the weighting 2 7 assigned in subsection 1, of forty-eight hundredths of the 2 8 percentage of the pupil's school day during which the pupil 2 9 attends class in the community college or attends a class 2 10 taught by a community college-employed teacher. The following 2 11 requirements shall be met for the purposes of assigning an 2 12 additional weighting for classes offered through a sharing 2 13 agreement between a school district and community college. 2 14 The class must be: 2 15 (1) Supplementing high school classes and not supplanting 2 16 a class that was offered in the preceding year or the second 2 17 preceding year. 2 18 (2) Included in the community college catalog or other 2 19 official college literature describing class offerings. 2 20 (3) Open to all registered community college students, not 2 21 just high school students. 2 22 (4) For college credit and the credit must apply toward an 2 23 associate of arts or associate of science degree, or toward an 2 24 associate of applied arts or associate of applied science 2 25 degree, or toward completion of a diploma program. 2 26 (5) Taught by a teacher meeting requirements for providing 2 27 instruction at the community college level. 2 28 (6) Taught utilizing the class syllabus approved by the 2 29 community college. 2 30 (7) Of the same quality as a class offered on a community 2 31 college campus. 2 32 4. AT-RISK PROGRAMS. 2 33 a. In order to provide additional funding to school 2 34 districts for programs serving at-risk pupils in grades nine 2 35 through twelve, a supplementary weighting plan for at-risk 3 1 pupils is adopted. Pupils identified as at-risk, based on the 3 2 number of pupils enrolled in grades nine through twelve who 3 3 are eligible for free or reduced price meals under the federal 3 4 National School Lunch Act and the federal Child Nutrition Act 3 5 of 1966, 42 U.S.C. } 1751-1785, are assigned a weighting, in 3 6 addition to the weighting assigned in subsection 1, of eleven 3 7 hundredths. Amounts received as supplemental weighting for 3 8 at-risk pupils may be utilized by a school district to develop 3 9 or maintain alternative programs for at-risk pupils, including 3 10 alternative high school programs, and shall be in addition to 3 11 and not supplanting moneys appropriated in section 279.51 and 3 12 moneys otherwise appropriated by law to supplement that 3 13 funding. 3 14 b. Notwithstanding paragraph "a", a school district which 3 15 received supplementary weighting for an alternative high 3 16 school program offered by a community college for the school 3 17 budget year beginning July 1, 1998, shall receive one hundred 3 18 percent of that amount for the school budget year beginning 3 19 July 1, 1999. Effective for the school budget year beginning 3 20 July 1, 2000, and for succeeding budget years, a school 3 21 district which received supplementary weighting for an 3 22 alternative high school program offered by a community college 3 23 for the school budget year beginning July 1, 1998, shall 3 24 receive a twenty percent reduction in that amount each year 3 25 until the amount generated by the eleven hundredths weighting 3 26 authorized in paragraph "a" is reached. 3 27 5. SHARED CLASSES DELIVERED OVER THE IOWA COMMUNICATIONS 3 28 NETWORK. A pupil attending a class in which students from one 3 29 or more other school districts are enrolled and which is 3 30 taught via the Iowa communications network is not deemed to be 3 31 attending a class in another school district or in a community 3 32 college for the purposes of this section and the school 3 33 district is not eligible for supplementary weighting for that 3 34 class under this section. 3 35 6. PUPILS INELIGIBLE. A pupil eligible for the weighting 4 1 plan provided in section 256B.9 is not eligible for 4 2 supplementary weighting pursuant to this section. 4 3 Sec. 2. Section 257.12, Code 1999, is repealed. 4 4 Sec. 3. This Act, being deemed of immediate importance, 4 5 takes effect upon enactment. 4 6 EXPLANATION 4 7 This bill provides supplementary weighting for determining 4 8 enrollment in school districts which are involved in sharing 4 9 programs on a district to district, or district to community 4 10 college, basis, and for at-risk programs. 4 11 For purposes of determining the amount of supplementary 4 12 weighting, pupils in a regular curriculum attending all their 4 13 classes in the district in which they reside, taught by 4 14 teachers employed by that district, and having administrators 4 15 employed by that district, are assigned a weighting of one. 4 16 The bill provides that school districts which send their 4 17 resident pupils to another school district, which jointly 4 18 employ and share the services of teachers under Code section 4 19 280.15, or which use the services of a teacher employed by 4 20 another school district, will have assigned to the pupils an 4 21 additional weighting of .48 of the percentage of the pupil's 4 22 school day during which the pupil is involved in the shared 4 23 program. In order to receive the supplementary weighting, the 4 24 school budget review committee must certify to the department 4 25 of management that the shared classes or teachers would 4 26 otherwise not be implemented without the assignment of 4 27 additional weighting. 4 28 The bill also provides that school districts which send 4 29 their resident pupils to a community college-offered class or 4 30 to a class taught by a community college-employed teacher will 4 31 have assigned to the pupils an additional weighting of .48 of 4 32 the percentage of the pupil's school day during which the 4 33 pupil is involved in the shared program, if the school budget 4 34 review committee certifies to the department of management 4 35 that the class would not otherwise be implemented without the 5 1 assignment of the supplementary weighting. The bill provides 5 2 that a number of requirements must be met regarding the nature 5 3 of the class or classes being taken in order to qualify for 5 4 supplementary weighting for programs shared by a district with 5 5 a community college. 5 6 The bill additionally provides that school districts will 5 7 receive supplementary weighting for programs serving at-risk 5 8 pupils in grades nine through 12. A weighting of .11 will be 5 9 assigned for pupils identified as at-risk, based on the number 5 10 of pupils enrolled in grades nine through 12 who are eligible 5 11 for free or reduced price meals. The bill provides that 5 12 amounts received as supplemental weighting for at-risk pupils 5 13 may be utilized by a school district to develop or maintain 5 14 alternative programs for at-risk pupils, including alternative 5 15 high school programs, and will be in addition to and not 5 16 supplanting other at-risk program moneys appropriated in Code 5 17 section 279.51 and moneys otherwise appropriated by law to 5 18 supplement that funding. The bill provides that a school 5 19 district which received supplementary weighting for an 5 20 alternative high school program offered by a community college 5 21 for the school budget year beginning July 1, 1998, will 5 22 receive 100 percent of that amount for the school budget year 5 23 beginning July 1, 1999, and an amount for succeeding budget 5 24 years representing a 20 percent decrease each year until the 5 25 amount generated by the .11 weighting is reached. 5 26 The bill provides that pupils attending a class in which 5 27 students from one or more other school districts are enrolled, 5 28 which is taught via the Iowa communications network, will not 5 29 be considered to be attending a class in another school 5 30 district or in a community college for purposes of qualifying 5 31 for supplementary weighting. The bill further provides that 5 32 pupils eligible for special education weighting pursuant to 5 33 Code section 256B.9 will not be eligible for supplementary 5 34 weighting for shared programs between school districts or 5 35 between a school district and a community college. 6 1 Additionally, the bill provides for the deletion of 6 2 provisions which previously authorized supplementary 6 3 weighting. The deleted provisions relate to the addition of 6 4 supplementary weighting amounts for school districts entering 6 5 into a whole grade sharing agreement pursuant to Code sections 6 6 282.10 through 282.12 beginning with the budget year beginning 6 7 on July 1, 1993, and for a five-year period for school 6 8 districts entering into a whole grade sharing agreement for 6 9 the budget years beginning July 1, 1991, and July 1, 1992. 6 10 Also deleted are provisions which had authorized supplementary 6 11 weighting for a five-year duration for school districts 6 12 entering into an agreement involving the joint employment of a 6 13 superintendent for the budget years beginning July 1, 1991, 6 14 and July 1, 1992, and supplementary weighting for a six-year 6 15 period for school districts undergoing a reorganization taking 6 16 effect on or before July 1, 1993. The bill further deletes 6 17 previously authorized supplementary weighting for shared 6 18 mathematics, science, and language classes for the budget 6 19 years beginning July 1, 1991, and July 1, 1992, and provisions 6 20 relating to the rounding off of supplementary weighting 6 21 calculations. 6 22 The bill would take effect upon enactment. 6 23 LSB 2083YC 78 6 24 rn/cf/24
