PAG LIN 1 1 Section 1. Section 232.2, subsection 12, paragraph c, Code 1 2 1999, is amended to read as follows: 1 3 c. The violation of section 123.47 or 708.7A, subsection 1 4 3, which is committed by a child. 1 5 Sec. 2. NEW SECTION. 708.7A RESTRICTIONS ON LASER 1 6 POINTERS. 1 7 1. A person commits laser pointer harassment when, with 1 8 the intent to intimidate, annoy, harass, or alarm a law 1 9 enforcement officer, the person points or aims a laser pointer 1 10 toward a law enforcement officer. 1 11 2. A person shall not sell, give, or otherwise supply a 1 12 laser pointer to any person under eighteen years of age. 1 13 3. A person under eighteen years of age shall not 1 14 purchase, or attempt to purchase, or possess a laser pointer. 1 15 4. For purposes of this section, "laser pointer" means any 1 16 pointing or siting device, a device that converts incident 1 17 electromagnetic radiation of mixed frequencies to one or more 1 18 discrete frequencies of highly amplified and coherent visible 1 19 radiation, or any other device that emits a light similar in 1 20 effect or appearance to that of a laser. 1 21 5. A person who violates this section commits a serious 1 22 misdemeanor. 1 23 EXPLANATION 1 24 This bill creates the new crime of laser pointer harassment 1 25 and provides penalties to certain persons who either sell, 1 26 possess, purchase, or attempt to purchase a laser pointer. 1 27 A person who aims a laser pointer at a law enforcement 1 28 officer with the intent to intimidate, annoy, or harass the 1 29 officer commits a serious misdemeanor. If a person sells, 1 30 gives, or supplies a laser pointer to a person under 18 years 1 31 of age, or if a person under 18 years of age possesses, 1 32 purchases, or attempts to purchase a laser pointer, the person 1 33 also commits a serious misdemeanor. The offense by a person 1 34 under 18 years of age is specifically included within the 1 35 definition of offenses which constitute delinquent acts under 2 1 the juvenile justice code. 2 2 A serious misdemeanor is punishable by confinement for no 2 3 more than one year and a fine of at least $250 but not more 2 4 than $1,500. 2 5 LSB 3087HC 78 2 6 jm/gg/8
