  1  1    Section 1.  REVIEW OF WATER QUALITY STANDARDS – AMMONIA
  1  2 REMOVAL.  The department of natural resources shall initiate a
  1  3 comprehensive review of the water quality standards in
  1  4 accordance with the federal Water Pollution Control Act of
  1  5 1972, Pub. L. No. 92-500, as amended by the federal Water
  1  6 Quality Act of 1987, Pub. L. No. 100-4, as published in 33
  1  7 U.S.C. } 1251-1376, which requires a triennial review of the
  1  8 state's water quality standards.  During the time in which the
  1  9 water quality standards are being reviewed, the department
  1 10 shall implement an interim strategy to address the issue of
  1 11 ammonia removal under permits issued pursuant to the Iowa
  1 12 national pollutant discharge elimination system permitting
  1 13 program.  During the review period, permits issued by the
  1 14 department under the permitting program shall include the
  1 15 following statement, "The effluent ammonia limits are based on
  1 16 the current ammonia water quality standard in the Iowa
  1 17 administrative code."  During the review period, if ammonia
  1 18 concentrations measured in the effluent at a permit holder's
  1 19 facility are significantly higher than the current limits
  1 20 listed in the Iowa administrative code, the permit holder
  1 21 shall plan for modifications to the design of the facility to
  1 22 provide for ammonia removal.  If the effluent is not deemed
  1 23 acutely toxic according to ammonia water quality standards,
  1 24 the department shall not take enforcement action regarding the
  1 25 effluent ammonia limits until the review of the water quality
  1 26 standards is completed.  When the review of the water quality
  1 27 standards is complete, all permits shall be modified to
  1 28 reflect any changes in the effluent ammonia limits.
  1 29    Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of
  1 30 immediate importance, takes effect upon enactment.  
  1 31                           EXPLANATION
  1 32    This bill provides that the department of natural resources
  1 33 shall initiate a comprehensive review of the water quality
  1 34 standards in accordance with the federal Clean Water Act which
  1 35 requires a triennial review of the state's water quality
  2  1 standards.  The bill provides that, during the review period,
  2  2 all of the following shall occur:
  2  3    1.  The department shall implement an interim strategy to
  2  4 address the issue of ammonia removal in permits issued under
  2  5 the Iowa national pollutant discharge elimination system
  2  6 permitting program.
  2  7    2.  If ammonia concentrations measured in the effluent are
  2  8 significantly higher than the current allowable limits, a
  2  9 permit holder shall plan modifications to the design of the
  2 10 facility to provide for ammonia removal.
  2 11    3.  If the effluent is not deemed acutely toxic, the
  2 12 department shall not take enforcement action until the review
  2 13 period is completed.
  2 14    The bill provides that when the review period is completed,
  2 15 all permits shall be modified to reflect any changes in the
  2 16 effluent ammonia limits.
  2 17    The bill is effective upon enactment.
