1 1 Section 1. Section 455B.474, subsection 1, paragraph h,
1 2 Code 1999, is amended by adding the following new
1 3 subparagraph:
1 4 NEW SUBPARAGRAPH. (4) In relation to a release for which
1 5 an owner or operator has received a no further action
1 6 certificate, the owner or operator shall not be subject to
1 7 either a civil enforcement action by an agency of this state
1 8 or a political subdivision of this state, or an action filed
1 9 pursuant to section 455B.112.
1 10 EXPLANATION
1 11 This bill provides that, in relation to a release for which
1 12 a no further action certificate has been issued, an owner or
1 13 operator of an underground storage tank shall not be subject
1 14 to a civil enforcement action by an agency of this state or a
1 15 political subdivision of this state, or a civil or criminal
1 16 action filed by the attorney general.
