  1  1    Section 1.  Section 715A.2A, subsection 3, Code 1999, is
  1  2 amended to read as follows:
  1  3    3.  An employer who violates this section shall cease and
  1  4 desist from further violations and shall pay the following
  1  5 civil penalty:
  1  6    a.  For a first violation, not less than two hundred and
  1  7 fifty five thousand dollars and not more than two ten thousand
  1  8 dollars for each unauthorized alien hired or employed.
  1  9    b.  For a second violation, not less than two ten thousand
  1 10 dollars and not more than five twenty-five thousand dollars
  1 11 for each unauthorized alien hired or employed.
  1 12    c.  For a third or subsequent violation, not less than
  1 13 three twenty-five thousand dollars and not more than ten fifty
  1 14 thousand dollars for each unauthorized alien hired or
  1 15 employed.
  1 16    In addition, an employer found to have violated this
  1 17 section shall be assessed the costs of the action to enforce
  1 18 the civil penalty, including the reasonable costs of
  1 19 investigation and attorney fees.  
  1 20                           EXPLANATION 
  1 21    This bill raises the applicable civil penalties for an
  1 22 employer who knowingly hires, or continues to hire, an
  1 23 unauthorized alien.  Specifically, the penalty for a first
  1 24 violation is raised from a range of $250 to $2,000, to $5,000
  1 25 to $10,000.  The penalty for a second violation is raised from
  1 26 a range of $2,000 to $5,000, to $10,000 to $25,000.  Finally,
  1 27 the penalty for a third or subsequent violation is raised from
  1 28 a range of $3,000 to $10,000, to $25,000 to $50,000.
