PAG LIN 1 1 Section 1. Section 257.31, subsection 5, paragraph j, Code 1 2 1999, is amended to read as follows: 1 3 j. Unusual need to continue providing a program or other 1 4 special assistance to non-English speaking pupils after the 1 5 expiration of thethree-yearfour-year period specified in 1 6 section 280.4. 1 7 Sec. 2. Section 280.4, subsection 3, Code 1999, is amended 1 8 to read as follows: 1 9 3. In order to provide funds for the excess costs of 1 10 instruction of limited English proficient students above the 1 11 costs of instruction of pupils in a regular curriculum, 1 12 students identified as limited English proficient shall be 1 13 assigned an additional weighting of twenty-five hundredths, 1 14 and that weighting shall be included in the weighted 1 15 enrollment of the school district of residence for a period 1 16 not exceedingthreefour years. However, the school budget 1 17 review committee may grant supplemental aid or modified 1 18 allowable growth to a school district to continue funding a 1 19 program for students after the expiration of thethree-year1 20 four-year period.The school budget review committee shall1 21calculate the additional amount for the weighting to the1 22nearest one-hundredth of one percent so that to the extent1 23possible the moneys generated by the weighting will be1 24equivalent to the moneys generated by the two-tenths weighting1 25provided prior to July 2, 1991.1 26 EXPLANATION 1 27 This bill provides for an additional weighting for students 1 28 identified as limited English proficient of twenty-five 1 29 hundredths, and extends the period of time during which the 1 30 additional weighting may be obtained from three to four years. 1 31 The bill deletes the previous provision that the additional 1 32 weighting shall be calculated by the school budget review 1 33 committee to the nearest one-hundredths of 1 percent so that 1 34 to the extent possible the moneys generated by the weighting 1 35 will be equivalent to the moneys generated by the two-tenths 2 1 weighting provided prior to July 2, 1991. 2 2 The bill provides for a corresponding change to Code 2 3 section 257.31, subsection 5, paragraph "j", concerning 2 4 requests by school districts for supplemental aid from the 2 5 school budget review committee based upon an unusual need to 2 6 continue a program relating to limited English proficiency 2 7 beyond a four-year period. 2 8 LSB 2084YC 78 2 9 rn/cf/24
