PAG LIN 1 1 Section 1. Section 702.7, Code 1999, is amended to read as 1 2 follows: 1 3 702.7 DANGEROUS WEAPON. 1 4 A "dangerous weapon" is any instrument or device designed 1 5 primarily for use in inflicting death or injury upon a human 1 6 being or animal, and which is capable of inflicting death upon 1 7 a human being when used in the manner for which it was 1 8 designed. Additionally, any instrument or device of any sort 1 9 whatsoever which is actually used in such a manner as to 1 10 indicate that the defendant intends to inflict death or 1 11 serious injury upon the other, and which, when so used, is 1 12 capable of inflicting death upon a human being, is a dangerous 1 13 weapon. Dangerous weapons include, but are not limited to, 1 14 any offensive weapon, pistol, revolver, or other firearm, 1 15 dagger, razor, stiletto, switchblade knife, or knife, 1 16 regardless of the type or style of construction, having a 1 17 bladeexceeding five inchesof three inches or longer in 1 18 length. 1 19 Sec. 2. Section 724.4, subsection 2 and 3, Code 1999, are 1 20 amended to read as follows: 1 21 2. A person who goes armed with a knife concealed on or 1 22 about the person, if the person uses the knife in the 1 23 commission of a crime, commitsan aggravated misdemeanora 1 24 class "D" felony. 1 25 3. A person who goes armed with a knife concealed on or 1 26 about the person, if the person does not use the knife in the 1 27 commission of a crime: 1 28 a. If the knife has a blade exceeding eight inches in 1 29 length, commits an aggravated misdemeanor. 1 30 b. If the knife has a bladeexceeding fivethree inches or 1 31 longer but not exceeding eight inches in length, commits a 1 32 serious misdemeanor. 1 33 EXPLANATION 1 34 This bill provides that the definition of "dangerous 1 35 weapon" includes a knife, regardless of the type or style of 2 1 construction, having a blade of three inches or longer in 2 2 length. 2 3 The bill provides that a person going armed with a 2 4 concealed knife when the person uses the knife in the 2 5 commission of a crime is guilty of a class "D" felony. 2 6 Currently, a person committing this crime is guilty of an 2 7 aggravated misdemeanor. 2 8 The bill provides that a person going armed with a 2 9 concealed knife, if the person does not use the knife in the 2 10 commission of a crime, commits a serious misdemeanor when the 2 11 blade of the knife is three inches or longer in length but 2 12 does not exceed eight inches in length. Currently, a serious 2 13 misdemeanor is committed when the blade of the knife exceeds 2 14 five inches but does not exceed eight inches in length. 2 15 LSB 2166HC 78 2 16 tm/gg/8
