PAG LIN 1 1 Section 1. Section 811.1, subsection 2, Code 1999, is 1 2 amended to read as follows: 1 3 2. A defendant appealing a conviction of a class "A" 1 4 felony,; murder,; any class "B" or "C" felony included in 1 5 section 707.6A,; a class "D" felony under section 707.6A, 1 6 subsection 3; felonious assault,; felonious child 1 7 endangerment,; sexual abuse in the second degree,; sexual 1 8 abuse in the third degree,; kidnapping,; robbery in the first 1 9 degree,; arson in the first degree, or; burglary in the first 1 10 degree,; any felony included in section 124.401, subsection 1, 1 11 paragraph "a",; or a violation of section 124.401, subsection 1 12 1, paragraph "b". 1 13 EXPLANATION 1 14 This bill amends Code section 811.1 to provide that certain 1 15 defendants convicted of vehicular manslaughter are not 1 16 bailable on appeal of their convictions. These defendants 1 17 include a person convicted of a class "C" felony for 1 18 unintentionally causing the death of another by driving a 1 19 motor vehicle recklessly or by eluding or attempting to elude 1 20 a pursuing law enforcement vehicle if the death directly or 1 21 indirectly results from the violation; and a person convicted 1 22 of a class "D" felony for unintentionally causing the death of 1 23 another while drag racing. The bill does not prohibit such 1 24 defendants from being admitted to bail pending sentencing. 1 25 Code section 811.1 currently provides that defendants 1 26 convicted of vehicular manslaughter for unintentionally 1 27 causing the death of another by operating a motor vehicle 1 28 while intoxicated, a class "B" felony, are not bailable on 1 29 appeal of their convictions. 1 30 LSB 1906HC 78 1 31 nh/cf/24
