  1  1    Section 1.  Section 96.7, subsection 2, paragraph a,
  1  2 subparagraph (2), Code 1999, is amended by adding the
  1  3 following new unnumbered paragraph:
  1  4    NEW UNNUMBERED PARAGRAPH.  If at least eighty percent of a
  1  5 contributory employer's employees in a specified location
  1  6 become unemployed and eligible for benefits for at least
  1  7 thirty days following a disaster at the location and if the
  1  8 employer substantially reopens its operations in that same
  1  9 area within eighteen months after the disaster first occurred,
  1 10 the employer's account shall not be charged with benefits the
  1 11 payment of which was directly caused by the disaster.  An
  1 12 employer's account shall be charged, however, if the
  1 13 unemployment is caused by the willful act of the employer or
  1 14 an agent of the employer.  Upon a determination by the
  1 15 department that an employer's account shall not be charged,
  1 16 the department shall, at the end of the calendar quarter in
  1 17 which the determination is made, bill the employer in the
  1 18 amount of benefits paid as a result of the disaster in the
  1 19 same manner as a reimbursable employer.  The employer shall
  1 20 pay the bill no later than four years following the date the
  1 21 bill was mailed or otherwise delivered.  The provisions for
  1 22 collection of contributions under section 96.14 are applicable
  1 23 to reimbursements for benefits paid as provided by this
  1 24 paragraph.  For purposes of this paragraph, "disaster" means
  1 25 the condemnation of property by a governmental agency, fire,
  1 26 flood, or other natural disaster.  
  1 27                           EXPLANATION
  1 28    This bill provides that the unemployment compensation
  1 29 account of an employer whose employees in a specified location
  1 30 become unemployed and eligible for benefits following a
  1 31 disaster at that location is not charged for the benefits paid
  1 32 if at least 80 percent of the employees are unemployed for at
  1 33 least 30 days following the disaster and the employer resumes
  1 34 operations in the same area within 18 months of the disaster.
  1 35 The bill defines disaster as the condemnation of property by a
  2  1 governmental agency, fire, flood, or other natural disaster.
  2  2 Upon a determination that an employer's account shall not be
  2  3 charged as a result of a disaster, the department shall bill
  2  4 the employer and the employer has four years to repay the
  2  5 benefits.  However, an employer shall be charged for benefits
  2  6 paid if the unemployment is due to the willful conduct of the
  2  7 employer or an agent of the employer.
