  1  4 APPROPRIATING FEDERAL FUNDS MADE AVAILABLE FROM FEDERAL BLOCK
  1  5    GRANTS AND OTHER FEDERAL GRANTS, ALLOCATING PORTIONS OF 
  1  6    FEDERAL BLOCK GRANTS, AND PROVIDING PROCEDURES IF FEDERAL 
  1  7    FUNDS ARE MORE OR LESS THAN ANTICIPATED OR IF FEDERAL BLOCK 
  1  8    GRANTS ARE MORE OR LESS THAN ANTICIPATED AND PROVIDING AN 
  1  9    EFFECTIVE DATE.  
  1 10 
  1 11 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 12 
  1 13    Section 1.  SUBSTANCE ABUSE APPROPRIATION.
  1 14    1.  There is appropriated from the fund created by section
  1 15 8.41 to the Iowa department of public health for the federal
  1 16 fiscal year beginning October 1, 2000, and ending September
  1 17 30, 2001, the following amount:  
  1 18 .................................................. $ 12,542,219
  1 19    a.  Funds appropriated in this subsection are the
  1 20 anticipated funds to be received from the federal government
  1 21 for the designated federal fiscal year under 42 U.S.C.,
  1 22 chapter 6A, subchapter XVII, which provides for the substance
  1 23 abuse prevention and treatment block grant.  The department
  1 24 shall expend the funds appropriated in this subsection as
  1 25 provided in the federal law making the funds available and in
  1 26 conformance with chapter 17A.
  1 27    b.  Of the funds appropriated in this subsection, an amount
  1 28 not exceeding 5 percent shall be used by the department for
  1 29 administrative expenses.
  1 30    c.  The department shall expend no less than an amount
  1 31 equal to the amount expended for treatment services in the
  1 32 state fiscal year beginning July 1, 1999, for pregnant women
  1 33 and women with dependent children.
  1 34    d.  Of the funds appropriated in this subsection, an amount
  1 35 not exceeding $24,585 shall be used for audits.
  2  1    2.  The funds remaining from the appropriation made in
  2  2 subsection 1 shall be allocated as follows:
  2  3    a.  At least 20 percent of the allocation shall be for
  2  4 prevention programs.
  2  5    b.  At least 35 percent of the allocation shall be spent on
  2  6 drug treatment and prevention activities.
  2  7    c.  At least 35 percent of the allocation shall be spent on
  2  8 alcohol treatment and prevention activities.
  2  9    3.  The substance abuse block grant funds received from the
  2 10 federal government in excess of the amount of the anticipated
  2 11 federal fiscal year 2000-2001 award appropriated in subsection
  2 12 1 shall be distributed at least 50 percent to treatment
  2 13 programs and 50 percent to prevention programs except that,
  2 14 based upon federal guidelines, the total amount of the excess
  2 15 awarded to prevention programs shall not exceed $1,000,000.
  2 16    Sec. 2.  COMMUNITY MENTAL HEALTH SERVICES APPROPRIATION.
  2 17    1.  a.  There is appropriated from the fund created by
  2 18 section 8.41 to the Iowa department of human services for the
  2 19 federal fiscal year beginning October 1, 2000, and ending
  2 20 September 30, 2001, the following amount:  
  2 21 .................................................. $  3,095,824
  2 22    b.  Funds appropriated in this subsection are the
  2 23 anticipated funds to be received from the federal government
  2 24 for the designated federal fiscal year under 42 U.S.C.,
  2 25 chapter 6A, subchapter XVII, which provides for the community
  2 26 mental health services block grant.  The department shall
  2 27 expend the funds appropriated in this subsection as provided
  2 28 in the federal law making the funds available and in
  2 29 conformance with chapter 17A.
  2 30    c.  The administrator of the division of mental health and
  2 31 developmental disabilities of the department of human services
  2 32 shall allocate not less than 95 percent of the amount of the
  2 33 block grant to eligible community mental health services
  2 34 providers for carrying out the plan submitted to and approved
  2 35 by the federal substance abuse and mental health services
  3  1 administration for the fiscal year involved.
  3  2    2.  An amount not exceeding 5 percent of the funds
  3  3 appropriated in subsection 1 shall be used by the department
  3  4 of human services for administrative expenses.  From the funds
  3  5 set aside by this subsection for administrative expenses, the
  3  6 division of mental health and developmental disabilities shall
  3  7 pay to the auditor of state an amount sufficient to pay the
  3  8 cost of auditing the use and administration of the state's
  3  9 portion of the funds appropriated in subsection 1.  The
  3 10 auditor of state shall bill the division of mental health and
  3 11 developmental disabilities for the costs of the audits.
  3 12    Sec. 3.  MATERNAL AND CHILD HEALTH SERVICES APPROPRIATIONS.
  3 13    1.  There is appropriated from the fund created by section
  3 14 8.41 to the Iowa department of public health for the federal
  3 15 fiscal year beginning October 1, 2000, and ending September
  3 16 30, 2001, the following amount:  
  3 17 .................................................. $  6,968,187
  3 18    The funds appropriated in this subsection are the funds
  3 19 anticipated to be received from the federal government for the
  3 20 designated federal fiscal year under 42 U.S.C., chapter 7,
  3 21 subchapter V, which provides for the maternal and child health
  3 22 services block grant.  The department shall expend the funds
  3 23 appropriated in this subsection as provided in the federal law
  3 24 making the funds available and in conformance with chapter
  3 25 17A.
  3 26    Of the funds appropriated in this subsection, an amount not
  3 27 exceeding $45,700 shall be used for audits.
  3 28    Funds appropriated in this subsection shall not be used by
  3 29 the university of Iowa hospitals and clinics for indirect
  3 30 costs.
  3 31    2.  An amount not exceeding $150,000 of the funds
  3 32 appropriated in subsection 1 to the Iowa department of public
  3 33 health shall be used by the Iowa department of public health
  3 34 for administrative expenses in addition to the amount to be
  3 35 used for audits in subsection 1.
  4  1    The departments of public health, human services, and
  4  2 education and the university of Iowa's mobile and regional
  4  3 child health specialty clinics shall continue to pursue to the
  4  4 maximum extent feasible the coordination and integration of
  4  5 services to women and children.
  4  6    3.  a.  Sixty-three percent of the remaining funds
  4  7 appropriated in subsection 1 shall be allocated to supplement
  4  8 appropriations for maternal and child health programs within
  4  9 the Iowa department of public health.  Of these funds,
  4 10 $284,548 shall be set aside for the statewide perinatal care
  4 11 program.
  4 12    b.  Thirty-seven percent of the remaining funds
  4 13 appropriated in subsection 1 shall be allocated to the
  4 14 university of Iowa hospitals and clinics under the control of
  4 15 the state board of regents for mobile and regional child
  4 16 health specialty clinics.  The university of Iowa hospitals
  4 17 and clinics shall not receive an allocation for indirect costs
  4 18 from the funds for this program.  Priority shall be given to
  4 19 establishment and maintenance of a statewide system of mobile
  4 20 and regional child health specialty clinics.
  4 21    4.  The Iowa department of public health shall administer
  4 22 the statewide maternal and child health program and the
  4 23 crippled children's program by conducting mobile and regional
  4 24 child health specialty clinics and conducting other activities
  4 25 to improve the health of low-income women and children and to
  4 26 promote the welfare of children with actual or potential
  4 27 handicapping conditions and chronic illnesses in accordance
  4 28 with the requirements of Title V of the federal Social
  4 29 Security Act.
  4 30    Sec. 4.  PREVENTIVE HEALTH AND HEALTH SERVICES
  4 31 APPROPRIATIONS.
  4 32    1.  There is appropriated from the fund created by section
  4 33 8.41 to the Iowa department of public health for the federal
  4 34 fiscal year beginning October 1, 2000, and ending September
  4 35 30, 2001, the following amount:  
  5  1 .................................................. $  1,945,069
  5  2    Funds appropriated in this subsection are the funds
  5  3 anticipated to be received from the federal government for the
  5  4 designated federal fiscal year under 42 U.S.C., chapter 6A,
  5  5 subchapter XVII, which provides for the preventive health and
  5  6 health services block grant.  The department shall expend the
  5  7 funds appropriated in this subsection as provided in the
  5  8 federal law making the funds available and in conformance with
  5  9 chapter 17A.
  5 10    Of the funds appropriated in this subsection, an amount not
  5 11 exceeding $5,522 shall be used for audits.
  5 12    2.  Of the funds appropriated in subsection 1, the specific
  5 13 amount of funds stipulated by the notice of block grant award
  5 14 shall be allocated for services to victims of sex offenses and
  5 15 for rape prevention education.
  5 16    3.  An amount not exceeding $94,670 of the remaining funds
  5 17 appropriated in subsections 1 and 2 shall be used by the Iowa
  5 18 department of public health for administrative expenses in
  5 19 addition to the amount to be used for audits in subsection 1.
  5 20    4.  After deducting the funds allocated in subsections 1,
  5 21 2, and 3, the remaining funds appropriated in subsection 1
  5 22 shall be used by the department for healthy people
  5 23 2010/healthy Iowans 2010 program objectives, preventive health
  5 24 advisory committee, and risk reduction services, including
  5 25 nutrition programs, health incentive programs, chronic disease
  5 26 services, emergency medical services, monitoring of the
  5 27 fluoridation program and start-up fluoridation grants, and
  5 28 acquired immune deficiency syndrome services.  The moneys
  5 29 specified in this subsection shall not be used by the
  5 30 university of Iowa hospitals and clinics or by the state
  5 31 hygienic laboratory for the funding of indirect costs.  Of the
  5 32 funds used by the department under this subsection, an amount
  5 33 not exceeding $90,000 shall be used for the monitoring of the
  5 34 fluoridation program and for start-up fluoridation grants to
  5 35 public water systems, and an amount not exceeding $50,000
  6  1 shall be used to provide chlamydia testing.
  6  2    Sec. 5.  DRUG CONTROL AND SYSTEM IMPROVEMENT GRANT PROGRAM
  6  3 APPROPRIATION.
  6  4    1.  There is appropriated from the fund created in section
  6  5 8.41 to the office of the governor for the drug enforcement
  6  6 and abuse prevention coordinator for the federal fiscal year
  6  7 beginning October 1, 2000, and ending September 30, 2001, the
  6  8 following amount:  
  6  9 .................................................. $  5,834,000
  6 10    Funds appropriated in this subsection are the anticipated
  6 11 funds to be received from the federal government for the
  6 12 designated fiscal year under 42 U.S.C., chapter 46, subchapter
  6 13 V, which provides for the drug control and system improvement
  6 14 grant program.  The drug enforcement and abuse prevention
  6 15 coordinator shall expend the funds appropriated in this
  6 16 subsection as provided in the federal law making the funds
  6 17 available and in conformance with chapter 17A.
  6 18    2.  An amount not exceeding 7 percent of the funds
  6 19 appropriated in subsection 1 shall be used by the drug
  6 20 enforcement and abuse prevention coordinator for
  6 21 administrative expenses.  From the funds set aside by this
  6 22 subsection for administrative expenses, the drug enforcement
  6 23 and abuse prevention coordinator shall pay to the auditor of
  6 24 state an amount sufficient to pay the cost of auditing the use
  6 25 and administration of the state's portion of the funds
  6 26 appropriated in subsection 1.
  6 27    Sec. 6.  STOP VIOLENCE AGAINST WOMEN GRANT PROGRAM
  6 28 APPROPRIATION.
  6 29    1.  There is appropriated from the fund created in section
  6 30 8.41 to the office of the governor for the drug enforcement
  6 31 and abuse prevention coordinator for the federal fiscal year
  6 32 beginning October 1, 2000, and ending September 30, 2001, the
  6 33 following amount:  
  6 34 .................................................. $  1,670,000
  6 35    Funds appropriated in this subsection are the anticipated
  7  1 funds to be received from the federal government for the
  7  2 designated fiscal year under 42 U.S.C., chapter 46, subchapter
  7  3 XII-H, which provides for grants to combat violent crimes
  7  4 against women.  The drug enforcement and abuse prevention
  7  5 coordinator shall expend the funds appropriated in this
  7  6 subsection as provided in the federal law making the funds
  7  7 available and in conformance with chapter 17A.
  7  8    2.  An amount not exceeding 5 percent of the funds
  7  9 appropriated in subsection 1 shall be used by the drug
  7 10 enforcement and abuse prevention coordinator for
  7 11 administrative expenses.  From the funds set aside by this
  7 12 subsection for administrative expenses, the drug enforcement
  7 13 and abuse prevention coordinator shall pay to the auditor of
  7 14 the state an amount sufficient to pay the cost of auditing the
  7 15 use and administration of the state's portion of the funds
  7 16 appropriated in subsection 1.
  7 17    Sec. 7.  LOCAL LAW ENFORCEMENT BLOCK GRANT APPROPRIATION.
  7 18    1.  There is appropriated from the fund created in section
  7 19 8.41 to the office of the governor for the drug enforcement
  7 20 and abuse prevention coordinator for the federal fiscal year
  7 21 beginning October 1, 2000, and ending September 30, 2001, the
  7 22 following amount:  
  7 23 .................................................. $    320,100
  7 24    Funds appropriated in this subsection are the funds
  7 25 anticipated to be received from the federal government for the
  7 26 designated federal fiscal year under annual federal
  7 27 appropriations which provide for grants to reduce crime and
  7 28 improve public safety.  The drug enforcement and abuse
  7 29 prevention coordinator shall expend the funds appropriated in
  7 30 this subsection as provided in the federal law making the
  7 31 funds available and in conformance with chapter 17A.
  7 32    2.  An amount not exceeding 3 percent of the funds
  7 33 appropriated in subsection 1 shall be used by the drug
  7 34 enforcement and abuse prevention coordinator for
  7 35 administrative expenses.  From the funds set aside by this
  8  1 subsection for administrative expenses, the drug enforcement
  8  2 and abuse prevention coordinator shall pay to the auditor of
  8  3 state an amount sufficient to pay the cost of auditing the use
  8  4 and administration of the state's portion of the funds
  8  5 appropriated in subsection 1.
  8  6    Sec. 8.  RESIDENTIAL SUBSTANCE ABUSE TREATMENT FOR STATE
  8  7 PRISONERS FORMULA GRANT PROGRAM.  There is appropriated from
  8  8 the fund created in section 8.41 to the office of the governor
  8  9 for the drug enforcement and abuse prevention coordinator for
  8 10 the federal fiscal year beginning October 1, 2000, and ending
  8 11 September 30, 2001, the following amount:  
  8 12 .................................................. $    520,237
  8 13    Funds appropriated in this section are the funds
  8 14 anticipated to be received from the federal government for the
  8 15 designated federal fiscal year under 42 U.S.C., chapter 136,
  8 16 which provides grants for substance abuse treatment programs
  8 17 in state and local correctional facilities.  The drug
  8 18 enforcement and abuse prevention coordinator shall expend the
  8 19 funds appropriated in this section as provided in the federal
  8 20 law making the funds available and in conformance with chapter
  8 21 17A.
  8 22    Sec. 9.  COMMUNITY SERVICES APPROPRIATIONS.
  8 23    1.  a.  There is appropriated from the fund created by
  8 24 section 8.41 to the division of community action agencies of
  8 25 the department of human rights for the federal fiscal year
  8 26 beginning October 1, 2000, and ending September 30, 2001, the
  8 27 following amount:  
  8 28 .................................................. $  5,676,277
  8 29    Funds appropriated in this subsection are the funds
  8 30 anticipated to be received from the federal government for the
  8 31 designated federal fiscal year under 42 U.S.C., chapter 106,
  8 32 which provides for the community services block grant.  The
  8 33 division of community action agencies of the department of
  8 34 human rights shall expend the funds appropriated in this
  8 35 subsection as provided in the federal law making the funds
  9  1 available and in conformance with chapter 17A.
  9  2    b.  The administrator of the division of community action
  9  3 agencies of the department of human rights shall allocate not
  9  4 less than 96 percent of the amount of the block grant to
  9  5 eligible community action agencies for programs benefiting
  9  6 low-income persons.  Each eligible agency shall receive a
  9  7 minimum allocation of not less than $100,000.  The minimum
  9  8 allocation shall be achieved by redistributing increased funds
  9  9 from agencies experiencing a greater share of available funds.
  9 10 The funds shall be distributed on the basis of the poverty-
  9 11 level population in the area represented by the community
  9 12 action areas compared to the size of the poverty-level
  9 13 population in the state.
  9 14    2.  An amount not exceeding 4 percent of the funds
  9 15 appropriated in subsection 1 shall be used by the division of
  9 16 community action agencies of the department of human rights
  9 17 for administrative expenses.  From the funds set aside by this
  9 18 subsection for administrative expenses, the division of
  9 19 community action agencies of the department of human rights
  9 20 shall pay to the auditor of state an amount sufficient to pay
  9 21 the cost of auditing the use and administration of the state's
  9 22 portion of the funds appropriated in subsection 1.  The
  9 23 auditor of state shall bill the division of community action
  9 24 agencies for the costs of the audits.
  9 25    Sec. 10.  COMMUNITY DEVELOPMENT APPROPRIATIONS.
  9 26    1.  There is appropriated from the fund created by section
  9 27 8.41 to the department of economic development for the federal
  9 28 fiscal year beginning October 1, 2000, and ending September
  9 29 30, 2001, the following amount:  
  9 30 .................................................. $ 30,038,000
  9 31    Funds appropriated in this subsection are the funds
  9 32 anticipated to be received from the federal government for the
  9 33 designated federal fiscal year under 42 U.S.C., chapter 69,
  9 34 which provides for community development block grants.  The
  9 35 department of economic development shall expend the funds
 10  1 appropriated in this subsection as provided in the federal law
 10  2 making the funds available and in conformance with chapter
 10  3 17A.
 10  4    2.  An amount not exceeding $1,401,520 for the federal
 10  5 fiscal year beginning October 1, 2000, shall be used by the
 10  6 department of economic development for administrative expenses
 10  7 for the community development block grant.  The total amount
 10  8 used for administrative expenses includes $700,760 for the
 10  9 federal fiscal year beginning October 1, 2000, of funds
 10 10 appropriated in subsection 1 and a matching contribution from
 10 11 the state equal to $600,760 from the appropriation of state
 10 12 funds for the community development block grant and state
 10 13 appropriations for related activities of the department of
 10 14 economic development.  From the funds set aside for
 10 15 administrative expenses by this subsection, the department of
 10 16 economic development shall pay to the auditor of state an
 10 17 amount sufficient to pay the cost of auditing the use and
 10 18 administration of the state's portion of the funds
 10 19 appropriated in subsection 1.  The auditor of state shall bill
 10 20 the department for the costs of the audit.
 10 21    3.  There is appropriated from the fund created by section
 10 22 8.41 to the department of economic development for the fiscal
 10 23 year beginning October 1, 1999, and ending September 30, 2000,
 10 24 the following amount:  
 10 25 .................................................. $  3,216,000
 10 26    Funds appropriated in this subsection are community
 10 27 development block grant moneys awarded to the state under Pub.
 10 28 L. No. 105-174, the Federal 1998 Supplemental Appropriations
 10 29 and Recissions Act.  The department of economic development
 10 30 shall expend the funds appropriated in this subsection as
 10 31 provided in the federal law making the funds available and in
 10 32 conformance with chapter 17A.  An amount not exceeding 2
 10 33 percent of the funds awarded shall be used by the department
 10 34 for administrative expenses.  From the funds set aside for
 10 35 administrative expenses, the department shall pay to the
 11  1 auditor of state an amount sufficient to pay the cost of
 11  2 auditing the use and administration of the state's portion of
 11  3 the funds appropriated in this subsection retroactively to
 11  4 October 1, 1997.
 11  5    Sec. 11.  LOW-INCOME HOME ENERGY ASSISTANCE APPROPRIATIONS.
 11  6    1.  There is appropriated from the fund created by section
 11  7 8.41 to the division of community action agencies of the
 11  8 department of human rights for the federal fiscal year
 11  9 beginning October 1, 2000, and ending September 30, 2001, the
 11 10 following amount:  
 11 11 .................................................. $ 19,951,229
 11 12    The funds appropriated in this subsection are the funds
 11 13 anticipated to be received from the federal government for the
 11 14 designated federal fiscal year under 42 U.S.C., chapter 94,
 11 15 subchapter II, which provides for the low-income home energy
 11 16 assistance block grants.  The division of community action
 11 17 agencies of the department of human rights shall expend the
 11 18 funds appropriated in this subsection as provided in the
 11 19 federal law making the funds available and in conformance with
 11 20 chapter 17A.
 11 21    2.  At least 15 percent of the amount appropriated in this
 11 22 section that is actually received shall be used for
 11 23 residential weatherization or other related home repairs for
 11 24 low-income households.  Of this allocation amount, not more
 11 25 than 10 percent may be used for administrative expenses.  In
 11 26 order to receive low-income home energy assistance program
 11 27 funding, the head of an eligible household must be willing to
 11 28 allow residential weatherization or other related home
 11 29 repairs.  However, if the eligible household is located in
 11 30 rental property, the unwillingness of the property owner to
 11 31 allow residential weatherization or other related home repairs
 11 32 shall not prevent the eligible household from receiving low-
 11 33 income home energy assistance program funding.
 11 34    3.  After subtracting the allocation in subsection 2,
 11 35 $1,695,854, or 10 percent of the remainder of the
 12  1 appropriation in this section actually received, whichever is
 12  2 less, is allocated for administrative expenses of the low-
 12  3 income home energy assistance program.  Not more than $290,000
 12  4 of the amount allocated in this subsection shall be used for
 12  5 administrative expenses of the division.  The costs of
 12  6 auditing the use and administration of the portion of the
 12  7 appropriation in this section that is retained by the state
 12  8 shall be paid from the amount allocated in this subsection to
 12  9 the division.  The auditor of state shall bill the division
 12 10 for the audit costs.
 12 11    4.  The remainder of the appropriation in this section
 12 12 following the allocations made in subsections 2 and 3, shall
 12 13 be used to help eligible households as defined in 42 U.S.C.,
 12 14 chapter 94, subchapter II, to meet home energy costs.
 12 15    5.  Not more than 10 percent of the amount appropriated in
 12 16 this section that is actually received, may be carried forward
 12 17 for use in the succeeding federal fiscal year.
 12 18    6.  Expenditures for assessment and resolution of energy
 12 19 problems shall be limited to 5 percent of the amount
 12 20 appropriated in this section that is actually received.
 12 21    Sec. 12.  SOCIAL SERVICES APPROPRIATIONS.
 12 22    1.  There is appropriated from the fund created by section
 12 23 8.41 to the department of human services for the federal
 12 24 fiscal year beginning October 1, 2000, and ending September
 12 25 30, 2001, the following amount:  
 12 26 .................................................. $  18,812,027
 12 27    Funds appropriated in this subsection are the funds
 12 28 anticipated to be received from the federal government for the
 12 29 designated federal fiscal year under 42 U.S.C., chapter 7,
 12 30 subchapter XX, which provides for the social services block
 12 31 grant.  The department of human services shall expend the
 12 32 funds appropriated in this subsection as provided in the
 12 33 federal law making the funds available and in conformance with
 12 34 chapter 17A.
 12 35    2.  Not more than $1,196,211 of the funds appropriated in
 13  1 subsection 1 shall be used by the department of human services
 13  2 for general administration.  From the funds set aside in this
 13  3 subsection for general administration, the department of human
 13  4 services shall pay to the auditor of state an amount
 13  5 sufficient to pay the cost of auditing the use and
 13  6 administration of the state's portion of the funds
 13  7 appropriated in subsection 1.
 13  8    3.  In addition to the allocation for general
 13  9 administration in subsection 2, the remaining funds
 13 10 appropriated in subsection 1 shall be allocated in the
 13 11 following amounts to supplement appropriations for the federal
 13 12 fiscal year beginning October 1, 2000, for the following
 13 13 programs within the department of human services:
 13 14    a.  Field operations:  
 13 15 .................................................. $  7,154,673
 13 16    b.  Child and family services:  
 13 17 .................................................. $  1,070,140
 13 18    c.  Local administrative costs and other local services:  
 13 19 .................................................. $    758,773
 13 20    d.  Volunteers:

 13 22    e.  Community-based services:

 13 24    f.  MH/MR/DD/BI community service (local purchase):  
 13 25 .................................................. $  8,453,938
 13 26    Sec. 13.  SOCIAL SERVICES BLOCK GRANT PLAN.  The department
 13 27 of human services during each state fiscal year shall develop
 13 28 a plan for the use of federal social services block grant
 13 29 funds for the subsequent state fiscal year.
 13 30    The proposed plan shall include all programs and services
 13 31 at the state level which the department proposes to fund with
 13 32 federal social services block grant funds, and shall identify
 13 33 state and other funds which the department proposes to use to
 13 34 fund the state programs and services.
 13 35    The proposed plan shall also include all local programs and
 14  1 services which are eligible to be funded with federal social
 14  2 services block grant funds, the total amount of federal social
 14  3 services block grant funds available for the local programs
 14  4 and services, and the manner of distribution of the federal
 14  5 social services block grant funds to the counties.  The
 14  6 proposed plan shall identify state and local funds which will
 14  7 be used to fund the local programs and services.
 14  8    The proposed plan shall be submitted with the department's
 14  9 budget requests to the governor and the general assembly.
 14 10    Sec. 14.  PROJECTS FOR ASSISTANCE IN TRANSITION FROM
 14 11 HOMELESSNESS.  Upon receipt of the minimum formula grant from
 14 12 the federal alcohol, drug abuse, and mental health
 14 13 administration to provide mental health services for the
 14 14 homeless, for the federal fiscal year beginning October 1,
 14 15 2000, and ending September 30, 2001, the division of mental
 14 16 health and developmental disabilities of the department of
 14 17 human services shall assure that a project which receives
 14 18 funds under the formula grant from either the federal or local
 14 19 match share of 25 percent in order to provide outreach
 14 20 services to persons who are chronically mentally ill and
 14 21 homeless or who are subject to a significant probability of
 14 22 becoming homeless shall do all of the following:
 14 23    1.  Provide community mental health services, diagnostic
 14 24 services, crisis intervention services, and habilitation and
 14 25 rehabilitation services.
 14 26    2.  Refer clients to medical facilities for necessary
 14 27 hospital services, and to entities that provide primary health
 14 28 services and substance abuse services.
 14 29    3.  Provide appropriate training to persons who provide
 14 30 services to persons targeted by the grant.
 14 31    4.  Provide case management to homeless persons.
 14 32    5.  Provide supportive and supervisory services to certain
 14 33 homeless persons living in residential settings which are not
 14 34 otherwise supported.
 14 35    6.  Projects may expend funds for housing services
 15  1 including minor renovation, expansion and repair of housing,
 15  2 security deposits, planning of housing, technical assistance
 15  3 in applying for housing, improving the coordination of housing
 15  4 services, the costs associated with matching eligible homeless
 15  5 individuals with appropriate housing, and one-time rental
 15  6 payments to prevent eviction.
 15  7    7.  If the department has data indicating that a geographic
 15  8 area has a substantial number of persons with mental illness
 15  9 who are homeless and are not being served by an existing
 15 10 grantee for that area under the formula grant and the existing
 15 11 grantee has expressed a desire to no longer provide services
 15 12 or the grantee's contract was terminated by the department for
 15 13 nonperformance, the department shall issue a request for
 15 14 proposals to replace the grantee.  Otherwise, the department
 15 15 shall maximize available funding by continuing to contract to
 15 16 the extent possible with those persons who are grantees as of
 15 17 the effective date of this subsection.  The department shall
 15 18 issue a request for proposals if additional funding becomes
 15 19 available for expansion to persons who are not being served
 15 20 and it is not possible to utilize existing grantees.
 15 21    Sec. 15.  CHILD CARE AND DEVELOPMENT APPROPRIATION.  There
 15 22 is appropriated from the fund created by section 8.41 to the
 15 23 department of human services for the federal fiscal year
 15 24 beginning October 1, 2000, and ending September 30, 2001, the
 15 25 following amount:  
 15 26 .................................................. $ 30,389,871
 15 27    Funds appropriated in this section are the funds
 15 28 anticipated to be received from the federal government under
 15 29 42 U.S.C., chapter 105, subchapter II-B, which provides for
 15 30 the child care and development block grant.  The department
 15 31 shall expend the funds appropriated in this section as
 15 32 provided in the federal law making the funds available and in
 15 33 conformance with chapter 17A.
 15 34    Sec. 16.  PROCEDURE FOR REDUCED FEDERAL FUNDS.
 15 35    1.  If the funds received from the federal government for
 16  1 the block grants specified in this Act are less than the
 16  2 amounts appropriated, the funds actually received shall be
 16  3 prorated by the governor for the various programs, other than
 16  4 for the services to victims of sex offenses and for rape
 16  5 prevention education under section 4, subsection 2, of this
 16  6 Act, for which each block grant is available according to the
 16  7 percentages that each program is to receive as specified in
 16  8 this Act.  However, if the governor determines that the funds
 16  9 allocated by the percentages will not be sufficient to effect
 16 10 the purposes of a particular program, or if the appropriation
 16 11 is not allocated by percentage, the governor may allocate the
 16 12 funds in a manner which will effect to the greatest extent
 16 13 possible the purposes of the various programs for which the
 16 14 block grants are available.
 16 15    2.  Before the governor implements the actions provided for
 16 16 in subsection 1, the following procedures shall be taken:
 16 17    a.  The chairpersons and ranking members of the senate and
 16 18 house standing committees on appropriations, the appropriate
 16 19 chairpersons and ranking members of subcommittees of those
 16 20 committees, the director of the legislative service bureau,
 16 21 and the director of the legislative fiscal bureau shall be
 16 22 notified of the proposed action.
 16 23    b.  The notice shall include the proposed allocations, and
 16 24 information on the reasons why particular percentages or
 16 25 amounts of funds are allocated to the individual programs, the
 16 26 departments and programs affected, and other information
 16 27 deemed useful.  Chairpersons notified shall be allowed at
 16 28 least two weeks to review and comment on the proposed action
 16 29 before the action is taken.
 16 30    3.  If the amount of moneys received from the federal
 16 31 government for a specific grant number specified in this Act
 16 32 is less than the amount appropriated, the amount appropriated
 16 33 shall be reduced accordingly.  An annual report listing any
 16 34 such appropriation reduction shall be submitted to the fiscal
 16 35 committee of the legislative council.
 17  1    Sec. 17.  PROCEDURE FOR INCREASED FEDERAL FUNDS.
 17  2    1.  If funds received from the federal government in the
 17  3 form of block grants exceed the amounts appropriated in
 17  4 sections 1, 2, 3, 4, 5, 7, 10, and 12 of this Act, the excess
 17  5 shall be prorated to the appropriate programs according to the
 17  6 percentages specified in those sections, except additional
 17  7 funds shall not be prorated for administrative expenses.
 17  8    2.  If actual funds received from the federal government
 17  9 from block grants exceed the amount appropriated in section 11
 17 10 of this Act for the low-income home energy assistance program,
 17 11 15 percent of the excess shall be allocated to the low-income
 17 12 residential weatherization program.
 17 13    3.  If funds received from the federal government from
 17 14 community services block grants exceed the amount appropriated
 17 15 in section 9 of this Act, 100 percent of the excess is
 17 16 allocated to the community services block grant program.
 17 17    4.  If the amount of moneys received from the federal
 17 18 government for a specific grant number specified in this Act
 17 19 exceeds the amount appropriated, the excess amount is
 17 20 appropriated for the purpose designated in the specific
 17 21 grant's appropriation.  An annual report listing any such
 17 22 excess appropriations shall be submitted to the fiscal
 17 23 committee of the legislative council.
 17 24    Sec. 18.  PROCEDURE FOR EXPENDITURE OF ADDITIONAL FEDERAL
 17 25 FUNDS.  If other federal grants, receipts, and funds and other
 17 26 nonstate grants, receipts, and funds become available or are
 17 27 awarded which are not available or awarded during the period
 17 28 in which the general assembly is in session, but which require
 17 29 expenditure by the applicable department or agency prior to
 17 30 March 15 of the fiscal year beginning July 1, 2000, and ending
 17 31 June 30, 2001, these grants, receipts, and funds are
 17 32 appropriated to the extent necessary, provided that the fiscal
 17 33 committee of the legislative council is notified within thirty
 17 34 days of receipt of the grants, receipts, or funds and the
 17 35 fiscal committee of the legislative council has an opportunity
 18  1 to comment on the expenditure of the grants, receipts, or
 18  2 funds.
 18  3    Sec. 19.  DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP.

 40  9    Sec. 51.  OFFICE OF SECRETARY OF STATE.  Federal grants,
 40 10 receipts, and funds and other nonstate grants, receipts, and
 40 11 funds, available in whole or in part for the fiscal year
 40 12 beginning July 1, 2000, and ending June 30, 2001, are
 40 13 appropriated to the office of secretary of state for the
 40 14 purposes set forth in the grants, receipts, or conditions
 40 15 accompanying the receipt of the funds, unless otherwise
 40 16 provided by law.
 40 17    Sec. 52.  IOWA STATE FAIR AUTHORITY.  Federal grants,
 40 18 receipts, and funds and other nonstate grants, receipts, and
 40 19 funds, available in whole or in part for the fiscal year
 40 20 beginning July 1, 2000, and ending June 30, 2001, are
 40 21 appropriated to the Iowa state fair authority for the purposes
 40 22 set forth in the grants, receipts, or conditions accompanying
 40 23 the receipt of the funds, unless otherwise provided by law.
 40 24    Sec. 53.  OFFICE OF STATE-FEDERAL RELATIONS.  Federal
 40 25 grants, receipts, and funds and other nonstate grants,
 40 26 receipts, and funds, available in whole or in part for the
 40 27 fiscal year beginning July 1, 2000, and ending June 30, 2001,
 40 28 are appropriated to the office of state-federal relations for
 40 29 the purposes set forth in the grants, receipts, or conditions
 40 30 accompanying the receipt of the funds, unless otherwise
 40 31 provided by law.
 40 32    Sec. 54.  IOWA TELECOMMUNICATIONS AND TECHNOLOGY
 40 33 COMMISSION.  Federal grants, receipts, and funds and other
 40 34 nonstate grants, receipts, and funds, available in whole or in
 40 35 part for the fiscal year beginning July 1, 2000, and ending
 41  1 June 30, 2001, are appropriated to the Iowa telecommunications
 41  2 and technology commission for the purposes set forth in the
 41  3 grants, receipts, or conditions accompanying the receipt of
 41  4 the funds, unless otherwise provided by law.
 41  5    Sec. 55.  OFFICE OF TREASURER OF STATE.  Federal grants,
 41  6 receipts, and funds and other nonstate grants, receipts, and
 41  7 funds, available in whole or in part for the fiscal year
 41  8 beginning July 1, 2000, and ending June 30, 2001, are
 41  9 appropriated to the office of treasurer of state for the
 41 10 purposes set forth in the grants, receipts, or conditions
 41 11 accompanying the receipt of the funds, unless otherwise
 41 12 provided by law.  The following amount is appropriated to the
 41 13 treasurer of state for the fiscal year beginning July 1, 2000,
 41 14 and ending June 30, 2001:

 43 23    Sec. 59.  LIHEAP FUNDING – DISCONNECTION PROHIBITION.  It
 43 24 is the intent of the general assembly that if the governor
 43 25 determines federal funds are insufficient to adequately
 43 26 provide for certification of eligibility for the low-income
 43 27 home energy assistance program by the community action
 43 28 agencies during the federal fiscal year which commences
 43 29 October 1, 2000, the Iowa utilities board shall issue an order
 43 30 prohibiting disconnection of service from November 1 through
 43 31 April 1 by a regulated public utility furnishing gas or
 43 32 electricity to households whose income falls at or below one
 43 33 hundred fifty percent of the federal poverty level as
 43 34 established by the United States office of management and
 43 35 budget.  The board shall promptly adopt rules in accordance
 44  1 with section 17A.4, subsection 2, and section 17A.5,
 44  2 subsection 2, paragraph "b", to implement this requirement.
 44  3 The energy assistance bureau of the department of human
 44  4 rights, in consultation with the community action agencies,
 44  5 shall certify to the utilities, households that are eligible
 44  6 for moratorium protection utilizing the agency's existing
 44  7 electronic database.  Rules adopted under this section shall
 44  8 also be published as a notice of intended action as provided
 44  9 in section 17A.4.
 44 10    Sec. 60.  EFFECTIVE DATE.  The following provisions of this
 44 11 Act, being deemed of immediate importance, take effect upon
 44 12 enactment:
 44 13    1.  Section 10, subsection 3, of this Act, appropriating
 44 14 federal community development block grant moneys for the
 44 15 federal fiscal year beginning October 1, 1999.
 44 16    2.  Section 14, subsection 7, relating to contracts for
 44 17 projects for assistance in transition from homelessness.
