1 4 RELATING TO LIMITATIONS ON RECOVERABLE NONECONOMIC DAMAGES
1 5 IN LEGAL ACTIONS ARISING OUT OF MOTOR VEHICLE ACCIDENTS.

1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 9 Section 1. NEW SECTION. 613.20 LIMITATION ON LIABILITY
1 10 OF MOTOR VEHICLE OPERATORS.
1 11 1. Except as provided in subsection 2, in an action to
1 12 recover damages arising out of the operation or use of a motor
1 13 vehicle, a person shall not recover noneconomic losses
1 14 including, but not limited to, pain and suffering if the
1 15 injured person was the operator of a motor vehicle, a
1 16 passenger in a motor vehicle, or a pedestrian and the person's
1 17 injuries were proximately caused by the person's commission of
1 18 any felony, or immediate flight therefrom, and the injured
1 19 person was duly convicted of that felony.
1 20 2. This section does not apply if the injured person is
1 21 found to have no fault in the accident.
1 22 3. If a person injured in a motor vehicle accident has
1 23 been formally charged with the violation of the felony
1 24 referred to in subsection 1, but a final determination
1 25 regarding guilt has not been made, liability and uninsured and
1 26 underinsured motorist insurers, to whom a claim for damages
1 27 has been presented, shall advise the injured party that
1 28 settlement of the claim will not be resolved until a final
1 29 judgment is rendered on the charges. The injured party
1 30 claiming damages shall provide evidence of the outcome of any
1 31 criminal charges.
