PAG LIN 1 1 HOUSE FILE 2522 1 2 1 3 AN ACT 1 4 RELATING TO ADDRESSES USED BY PERSONS SEEKING RELIEF FROM 1 5 DOMESTIC ABUSE. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. Section 236.3, subsections 1 and 2, Code 1999, 1 10 are amended to read as follows: 1 11 1. Name of the plaintiff and the name and address of the 1 12 plaintiff's attorney, if any. If the plaintiff is proceeding 1 13 pro se, the petition shall state a mailing address for the 1 14 plaintiff. A mailing address may be provided by the plaintiff 1 15 pursuant to section 236.10. 1 16 2. Name and address of the parent or guardian filing the 1 17 petition, if the petition is being filed on behalf of an 1 18 unemancipated minor. For the purposes of this chapter, 1 19 "plaintiff" includes a person filing an action on behalf of an 1 20 unemancipated minor. A mailing address may be provided by the 1 21 plaintiff pursuant to section 236.10. 1 22 Sec. 2. Section 236.10, Code 1999, is amended to read as 1 23 follows: 1 24 236.10 CONFIDENTIALITY OF RECORDS. 1 25 1. A person seeking relief from domestic abuse under this 1 26 chapter may use any of the following addresses as a mailing 1 27 address for purposes of filing a petition under this chapter, 1 28 as well as for the purpose of obtaining any utility or other 1 29 service: 1 30 a. The mailing address of a shelter or other agency. 1 31 b. A public or private post office box. 1 32 c. Any other mailing address, with the permission of the 1 33 resident of that address. 1 34 2. A person shall report any change of address, whether 1 35 designated according to subsection 1 or otherwise, to the 2 1 clerk of court no more than five days after the previous 2 2 address on record becomes invalid. 2 3 3. The file in a domestic abuse case shall be sealed by 2 4 the clerk of court when it is complete and after the time for 2 5 appeal has expired. However, the clerk shall open the file 2 6 upon application to and order of the court for good cause 2 7 shown or upon request of the child support recovery unit. 2 8 Support payment records, whether maintained by the clerk of 2 9 the district court or the department of human services, are 2 10 public records and may be released upon request.
