PAG LIN 1 1 HOUSE FILE 2519 1 2 1 3 AN ACT 1 4 RELATING TO PROBATION AND PAROLE BY EXTENDING THE REPEAL OF THE 1 5 SIXTH JUDICIAL DISTRICT PILOT PROJECT CONCERNING PROBATION 1 6 REVOCATION HEARINGS AND BY ESTABLISHING THE POSITION OF VICE 1 7 CHAIRPERSON OF THE BOARD OF PAROLE, AND PROVIDING AN EFFECTIVE 1 8 DATE. 1 9 1 10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 11 1 12 Section 1. Section 904A.1, Code 1999, is amended to read 1 13 as follows: 1 14 904A.1 BOARD OF PAROLE. 1 15 The board of parole is created to consist of five members. 1 16 Each member, except the chairperson and the vice chairperson, 1 17 shall be compensated on a day-to-day basis. Each member shall 1 18 serve a term of four years beginning and ending as provided by 1 19 section 69.19, except for members appointed to fill vacancies 1 20 who shall serve for the balance of the unexpired term. The 1 21 terms shall be staggered. The chairperson and vice 1 22 chairperson of the board shall beafull-time, salariedmember1 23 members of the board. A majority of the members of the board 1 24 constitutes a quorum to transact business. 1 25 Sec. 2. NEW SECTION. 904A.4C VICE CHAIRPERSON OF THE 1 26 BOARD OF PAROLE. 1 27 The vice chairperson of the board of parole shall be 1 28 appointed from the membership of the board of parole by the 1 29 governor. The vice chairperson shall serve at the pleasure of 1 30 the governor and shall have such responsibilities and duties 1 31 as are determined by the chairperson. The vice chairperson 1 32 shall act as the chairperson in the absence or disability of 1 33 the chairperson or in the event of a vacancy in that office, 1 34 until such time as a new chairperson is appointed by the 1 35 governor. 2 1 Sec. 3. Section 904A.6, Code 1999, is amended to read as 2 2 follows: 2 3 904A.6 SALARIES AND EXPENSES. 2 4 Each member, except the chairperson and the vice 2 5 chairperson, of the board shall be paid per diem as determined 2 6 by the general assembly. The chairperson and vice chairperson 2 7 of the board shall be paid a salary as determined by the 2 8 general assembly. Each member of the board and all employees 2 9 are entitled to receive, in addition to their per diem or 2 10 salary, their necessary maintenance and travel expenses while 2 11 engaged in official business. 2 12 Sec. 4. 1998 Iowa Acts, chapter 1197, section 13, is 2 13 amended to read as follows: 2 14 SEC. 13. EFFECTIVE DATES – REPEALS. 2 15 1. This division and Division I of this Act, being deemed 2 16 of immediate importance, take effect upon enactment. 2 17 2. Division I of this Act is repealed June 30,20002002. 2 18 3. Division II of this Act takes effect July 1,20002002. 2 19 Sec. 5. EFFECTIVE DATE.
