1 1 Section 1. Section 252B.5, Code 1999, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 12. The option of mediation of an action.
1 4 In an action involving the unit, following the issuance of a
1 5 final decision pursuant to chapter 17A, a party to the action
1 6 may request, prior to judicial review, participation in
1 7 mediation pursuant to chapter 679C to facilitate resolution of
1 8 the action. A party that requests mediation under this
1 9 subsection retains the right to judicial review of the action.
1 10 The costs of mediation shall be paid by the party requesting
1 11 mediation, unless the mediation agreement otherwise provides.
1 12 EXPLANATION
1 13 This bill provides that the child support recovery unit is
1 14 to provide the option of mediation to facilitate resolution of
1 15 an action involving the child support recovery unit, following
1 16 issuance of a final decision pursuant to Code chapter 17A, and
1 17 prior to judicial review of the action. A party to the action
1 18 may request mediation, pursuant to Code chapter 679C, but
1 19 retains the right to judicial review. The costs of mediation
1 20 are to be paid by the party requesting mediation unless the
1 21 mediation agreement otherwise provides.
