  1  4 CREATING AN IOWA LEWIS AND CLARK BICENTENNIAL COMMISSION,
  1  5    AN IOWA LEWIS AND CLARK BICENTENNIAL FUND, AND PROVIDING
  1  6    AN EFFECTIVE DATE.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  NEW SECTION.  15.221  IOWA LEWIS AND CLARK
  1 11 BICENTENNIAL COMMISSION.
  1 12    1.  The Iowa Lewis and Clark bicentennial commission is
  1 13 established in the department of economic development for
  1 14 purposes of coordinating and promoting the observance of this
  1 15 state's bicentennial commemoration of the Lewis and Clark
  1 16 expedition.  The commission shall be organized and shall
  1 17 operate as a nonprofit corporation within this state in
  1 18 accordance with chapter 504A.
  1 19    2.  The commission shall be composed of seven members
  1 20 consisting of all of the following:
  1 21    a.  The director of the department of cultural affairs or
  1 22 the director's designee.
  1 23    b.  The administrator of the division of tourism within the
  1 24 department of economic development, or the administrator's
  1 25 designee.
  1 26    c.  The administrator of the parks and preserves division
  1 27 within the department of natural resources, or the
  1 28 administrator's designee.
  1 29    d.  The administrator of the historical division within the
  1 30 department of cultural affairs, or the administrator's
  1 31 designee.
  1 32    e.  The remaining three members shall be appointed by the
  1 33 governor, subject to confirmation by the senate.  The members
  1 34 appointed by the governor shall have an interest or expertise
  1 35 in the history of the Lewis and Clark expedition.  At least
  2  1 one of the members appointed by the governor shall be a member
  2  2 of an Indian tribe encountered by the Lewis and Clark
  2  3 expedition.
  2  4    3.  The members appointed by the governor shall be
  2  5 appointed in compliance with sections 69.16 and 69.16A and
  2  6 shall serve three-year terms beginning and ending as provided
  2  7 by section 69.19.  Members appointed by the governor may be
  2  8 reappointed.
  2  9    4.  The commission shall annually elect a chairperson and
  2 10 vice chairperson from the members of the commission.
  2 11    5.  Commission members shall serve without compensation,
  2 12 but shall be reimbursed for actual and necessary expenses.
  2 13    Sec. 2.  NEW SECTION.  15.222  POWERS.
  2 14    The commission may do all of the following:
  2 15    1.  Cooperate with other entities conducting national,
  2 16 regional, state, or local events promoting the bicentennial.
  2 17    2.  Plan, assist, coordinate, or conduct bicentennial
  2 18 events.
  2 19    3.  Engage in fund-raising activities, including revenue-
  2 20 earning enterprises and the solicitation of grants, gifts, and
  2 21 donations.
  2 22    4.  Promote public education concerning the Lewis and Clark
  2 23 expedition.
  2 24    5.  Coordinate interagency participation in the observance
  2 25 and work with appropriate federal entities such as the
  2 26 national park service, the United States forest service, and
  2 27 the United States army.
  2 28    6.  Appoint various local and regional advisory committees.
  2 29    7.  Perform any other related duties.
  2 30    Sec. 3.  NEW SECTION.  15.223  IOWA LEWIS AND CLARK
  2 31 BICENTENNIAL FUND.
  2 32    An Iowa Lewis and Clark bicentennial fund is created as a
  2 33 separate fund in the state treasury under the control of the
  2 34 commission.  The assets of the fund shall be used by the
  2 35 commission only for carrying out the purposes of this part.
  3  1 The fund shall consist of any moneys appropriated by the
  3  2 general assembly for that purpose and any other moneys
  3  3 available to and obtained or accepted by the commission for
  3  4 placement in the fund.  Notwithstanding section 8.33, moneys
  3  5 in the Iowa Lewis and Clark bicentennial fund at the end of
  3  6 each fiscal year shall not revert to any other fund but shall
  3  7 remain in the Lewis and Clark bicentennial fund for
  3  8 expenditure for subsequent fiscal years.
  3  9    Sec. 4.  NEW SECTION.  15.224  RULES.
  3 10    The department, in cooperation with the commission, may
  3 11 adopt administrative rules pursuant to chapter 17A necessary
  3 12 to accomplish the purpose of the commission.
  3 13    Sec. 5.  NEW SECTION.  15.225  TERMINATION.
  3 14    The Iowa Lewis and Clark bicentennial commission shall
  3 15 dissolve by December 31, 2007.
  3 16    Sec. 6.  EFFECTIVE DATE.  This Act, being deemed of
  3 17 immediate importance, takes effect upon enactment.
