  1  1    Section 1.  Section 307.25, Code 1999, is amended to read
  1  2 as follows:
  1  3    307.25  AERONAUTICS AND PUBLIC TRANSIT WATER.
  1  4    A division of aeronautics and water is created within the
  1  5 department under the control of an administrator of
  1  6 aeronautics and water appointed by the director.  The
  1  7 department's administrator for aeronautics and public transit
  1  8 water shall:
  1  9    1.  Advise and assist the director in the development of
  1 10 aeronautics, including but not limited to the location of air
  1 11 terminals, accessibility of air terminals by other modes of
  1 12 public transportation, protective zoning provisions
  1 13 considering safety factors, noise, and air pollution,
  1 14 facilities for private and commercial aircraft, air freight
  1 15 facilities, and such other physical and technical aspects as
  1 16 may be necessary to meet present and future needs.
  1 17    2.  Advise and assist the director in the study of local
  1 18 and regional transportation of goods and people including
  1 19 intracity and intercity bus systems, dial-a-bus facilities,
  1 20 rural and urban bus and taxi systems, the collection of data
  1 21 from these systems, feasibility study of increased government
  1 22 subsidy assistance and determination of the allocation of such
  1 23 subsidies to each mass transportation system, such other
  1 24 physical and technical aspects which may be necessary to meet
  1 25 present and future needs and apply for, accept and expend
  1 26 federal, state or private funds for the improvement of mass
  1 27 transit.  Promote river transportation and coordinate river
  1 28 programs with other transportation modes.
  1 29    3.  Advise and assist the director to study and develop
  1 30 highway transport economics to assure availability and
  1 31 productivity of highway transport services.  Advise and assist
  1 32 the director in the development of river transportation and
  1 33 port facilities in the state.
  1 34    4.  Take the necessary steps to achieve the purposes set
  1 35 forth in chapter 307C, pursuant to section 307C.3.
  2  1    4. 5.  Administer chapters 328, 329, and 330.
  2  2    5. 6.  Perform other duties and responsibilities as
  2  3 assigned by the director.
  2  4    Sec. 2.  Section 307.26, unnumbered paragraph 1, Code 1999,
  2  5 is amended to read as follows:
  2  6    The department's administrator for rail and water public
  2  7 transit shall:
  2  8    Sec. 3.  Section 307.26, subsections 16 and 17, Code 1999,
  2  9 are amended by striking the subsections and inserting in lieu
  2 10 thereof the following:
  2 11    16.  Advise and assist the director in the study of local
  2 12 and regional transportation of goods and people including
  2 13 intracity and intercity bus systems, dial-a-bus facilities,
  2 14 rural and urban bus and taxi systems, the collection of data
  2 15 from these systems, feasibility study of increased government

  2 22    17.  Advise and assist the director to study and develop

  2 25    Sec. 4.  Section 307C.3, Code 1999, is amended to read as
  2 26 follows:
  2 27    307C.3  DUTIES OF THE STATE DEPARTMENT OF TRANSPORTATION
  2 28 DIVISION OF AERONAUTICS AND WATER.
  2 29    The division of aeronautics and water of the state
  2 30 department of transportation shall, with the cooperation of
  2 31 the Iowa department of economic development, the department of
  2 32 natural resources, and the member states' officials or
  2 33 agencies, take the necessary steps to achieve the purposes set
  2 34 forth in this chapter.
  2 35    Sec. 5.  Section 327D.192, Code 1999, is amended to read as
  3  1 follows:
  3  2    327D.192  SPOT CHECKS FOR HAZARDOUS CARGO.
  3  3    An employee under the supervision of the department's
  3  4 administrator for rail and water public transit designated by
  3  5 the director of the department may conduct spot inspections of
  3  6 vehicles subject to registration which are owned or operated
  3  7 by a railroad corporation to determine whether a vehicle is
  3  8 used to transport products or property which may be a safety
  3  9 hazard for the operator of the vehicle subject to registration
  3 10 or any other employee of the railroad corporation who is
  3 11 transported in the vehicle.
  3 12    Sec. 6.  Section 327F.39, subsection 1, paragraph c, Code
  3 13 1999, is amended to read as follows:
  3 14    c.  "Administrator" means the department's administrator
  3 15 for rail and water public transit, or the administrator's
  3 16 designee.
  3 17    Sec. 7.  Section 328.1, subsection 11, Code 1999, is
  3 18 amended to read as follows:
  3 19    11.  "Air taxi operator" means an operator who engages in
  3 20 the air transportation of passengers, property, and mail by
  3 21 aircraft on public demand for compensation and does not
  3 22 directly or indirectly utilize aircraft with a capacity of
  3 23 more than thirty passengers or seventy-five hundred pounds
  3 24 maximum payload, unless exempted by the aeronautics and public
  3 25 transit water administrator of the department.  
  3 26                           EXPLANATION
  3 27    This bill creates a division of aeronautics and water
  3 28 within the state department of transportation under the
  3 29 control of an administrator for aeronautics and water.
  3 30 Currently, the Code provides for an administrator for
  3 31 aeronautics and public transit and an administrator for rail
  3 32 and water within the department.
  3 33    The bill delegates the existing duties of the administrator
  3 34 for rail and water which relate to water to the newly titled
  3 35 administrator for aeronautics and water.  The bill also
  4  1 delegates the existing duties of the administrator for
  4  2 aeronautics and public transit which relate to public transit
  4  3 to the newly titled administrator for rail and public transit.
  4  4    In addition, the bill designates the new division of
  4  5 aeronautics and water as the entity responsible for
  4  6 implementing the Missouri river barge compact in Code chapter
  4  7 307C, in cooperation with the Iowa department of economic
  4  8 development, the department of natural resources, and the
  4  9 compact member states' officials or agencies.  Currently, the
  4 10 state department of transportation is responsible for such
  4 11 implementation, in cooperation with the designated entities
  4 12 and persons.
  4 13    The bill also makes corresponding Code language changes in
  4 14 Code sections 327D.192, 327F.39, and 328.1.
