1 1 Section 1. Section 147.107, Code 1999, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 9A. If a health care practitioner
1 4 authorized to prescribe prescription drugs for human beings
1 5 identifies a prescription drug the practitioner believes may
1 6 be beneficial for treatment of a patient condition but the
1 7 practitioner is reasonably uncertain of the effects of the
1 8 drug upon the patient and has available an adequate quantity
1 9 of samples of the drug to determine the drug's relative
1 10 benefit to the patient, the practitioner shall dispense the
1 11 drug samples without charge to the patient for the patient's
1 12 initial usage of the drug.
1 13 EXPLANATION
1 14 This bill relates to dispensing of prescription drug
1 15 samples by certain health care practitioners. The bill amends
1 16 Code section 147.107 relating to drug dispensing, supplying,
1 17 and prescribing. The bill applies to the following health
1 18 care practitioners listed in that section who are authorized
1 19 to prescribe certain prescription drugs for humans:
1 20 physicians, dentists, podiatric physicians, physician
1 21 assistants, and advanced registered nurse practitioners who
1 22 are qualified for and are registered in a recognized nursing
1 23 specialty.
