  1  4 ESTABLISHING A CRIMINAL OFFENSE RELATING TO THEFT
  1  5    DETECTION SHIELDING DEVICES AND THEFT DETECTION DEVICES AND
  1  6    PROVIDING A PENALTY.  
  1  7 
  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  NEW SECTION.  714.7B  THEFT DETECTION DEVICES
  1 11 – SHIELD OR REMOVAL PROHIBITED.
  1 12    1.  A person shall not intentionally manufacture or attempt
  1 13 to manufacture, sell or attempt to sell, possess, use,
  1 14 distribute or attempt to distribute, a theft detection
  1 15 shielding device.
  1 16    2.  A person shall not remove or attempt to remove a theft
  1 17 detection device with the intent of committing a theft and
  1 18 without the permission of the merchant who is displaying or
  1 19 selling the goods, wares, or merchandise.
  1 20    3.  A person shall not possess any tool, instrument, or
  1 21 device with the intent to use it in the unlawful removal of a
  1 22 theft detection device.
  1 23    4.  For purposes of this section, "theft detection
  1 24 shielding device" means any laminated or coated bag or device
  1 25 designed to shield merchandise from detection by an electronic
  1 26 or magnetic theft alarm system or any other system designed to
  1 27 alert a person of a possible theft.  "Theft detection device"
  1 28 means any electronic or other device attached to goods, wares,
  1 29 or merchandise on display or for sale by a merchant.
  1 30    5.  A person who violates subsection 1 or 3 commits a
  1 31 serious misdemeanor.
  1 32    6.  A person who violates subsection 2 commits the
  1 33 following:
  1 34    a.  A simple misdemeanor if the value of the goods, wares,
  1 35 or merchandise does not exceed two hundred dollars.
  2  1    b.  A serious misdemeanor if the value of the goods, wares,
  2  2 or merchandise exceeds two hundred dollars.
