  1  1    Section 1.  Section 598.41A, Code 1999, is amended to read
  1  2 as follows:
  1  3    598.41A  VISITATION – HISTORY OF CRIMES AGAINST A MINOR.
  1  4    Notwithstanding section 598.41, the court shall consider in
  1  5 the award of visitation rights to a parent of a child, the
  1  6 criminal history of the parent if the parent has been
  1  7 convicted of a criminal offense against a minor, an aggravated
  1  8 offense, a sexually violent offense against a minor, or sexual
  1  9 exploitation of a minor.  As used in this section, "criminal
  1 10 offense against a minor", "aggravated offense", "sexually
  1 11 violent offense", and "sexual exploitation" mean as defined in
  1 12 section 692A.1.  
  1 13                           EXPLANATION
  1 14    This bill relates to visitation rights of a parent who has
  1 15 been convicted of certain crimes.
  1 16    The bill provides that the court in awarding visitation
  1 17 rights to a parent shall consider whether the parent has
  1 18 committed an aggravated offense defined in Code section
  1 19 692A.1.  An aggravated offense is generally defined as sexual
  1 20 abuse, other felonies that involve sexual abuse as an element
  1 21 of the offense, or lascivious acts.  Under existing law, the
  1 22 court in awarding visitation rights to a parent shall only
  1 23 consider whether the parent has committed a criminal offense
  1 24 against a minor, a sexually violent offense, and sexual
  1 25 exploitation.
