1 1 Section 1. Section 124.212, Code 1999, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 6. EPHEDRINE SALES RESTRICTED – PENALTY.
1 4 If a person sells drug products described in subsection 5,
1 5 paragraph "b", subparagraph (1) or (2), to a person under
1 6 eighteen years of age, the person selling the drug product
1 7 commits a simple misdemeanor.
1 8 Sec. 2. NEW SECTION. 126.24 SALE OF CREATININE TO
1 9 PERSONS UNDER EIGHTEEN YEARS OF AGE – PENALTY.
1 10 A person shall not sell creatinine or any compound,
1 11 mixture, or preparation containing creatinine to a person
1 12 under eighteen years of age. A person violating this section
1 13 commits a simple misdemeanor.
1 14 EXPLANATION
1 15 This bill establishes a criminal offense for selling
1 16 certain ephedrine products or creatinine to a person under 18
1 17 years of age.
1 18 Under existing law, a person may lawfully sell to anyone
1 19 certain ephedrine products. This bill provides that a person
1 20 shall not sell certain ephedrine products to a person under 18
1 21 years of age.
1 22 The bill also prohibits the sale of creatinine, or products
1 23 containing creatinine, to a person under 18 years of age.
1 24 A person who commits a violation of this bill commits a
1 25 simple misdemeanor. A simple misdemeanor is punishable by
1 26 confinement for no more than 30 days or a fine of at least $50
1 27 but not more than $500 or both.
