1 1 Section 1. Section 144A.3, subsection 2, paragraph a, Code
1 2 1999, is amended by adding the following new unnumbered
1 3 paragraph:
1 4 NEW UNNUMBERED PARAGRAPH. Notwithstanding any provision of
1 5 this paragraph "a" to the contrary, a chaplain or other
1 6 religious leader or a person engaged in the practice of social
1 7 work as defined pursuant to section 154C.1, whether or not
1 8 licensed to practice social work, who is officially associated
1 9 with or employed by a health care provider, may act as a
1 10 witness for a declaration.
1 11 Sec. 2. Section 144B.3, subsection 2, Code 1999, is
1 12 amended by adding the following new unnumbered paragraph:
1 13 NEW UNNUMBERED PARAGRAPH. Notwithstanding any provision of
1 14 this subsection to the contrary, a chaplain or other religious
1 15 leader or a person engaged in the practice of social work as
1 16 defined pursuant to section 154C.1, whether or not licensed to
1 17 practice social work, who is officially associated with or
1 18 employed by a health care provider, may act as a witness for a
1 19 durable power of attorney for health care.
1 20 EXPLANATION
1 21 This bill provides that a chaplain or other religious
1 22 leader or a person engaged in the practice of social work,
1 23 whether or not licensed to practice social work, who is
1 24 officially associated with or employed by a health care
1 25 provider, may act as a witness to a declaration executed under
1 26 the life-sustaining procedures law or to a durable power of
1 27 attorney for health care document.
