PAG LIN 1 1 Section 1. NEW SECTION. 18.21 IOWA AGRICULTURAL 1 2 COMMODITIES PREFERENCE. 1 3 1. As used in this section: 1 4 a. "Agricultural commodity" means a commodity that may be 1 5 processed into food, including but not limited to livestock, 1 6 crops, vegetables, nuts, seeds, honey, eggs, or milk existing 1 7 in an unprocessed state. 1 8 b. "Iowa agricultural commodity" means an agricultural 1 9 commodity that is produced on a farm located in this state. 1 10 2. a. When purchasing agricultural commodities for 1 11 processing into food, the department shall purchase Iowa 1 12 agricultural commodities, if the price is reasonably 1 13 competitive and the quality meets departmental standards. 1 14 b. When purchasing food, the department shall purchase 1 15 food that has been processed from Iowa agricultural 1 16 commodities, if the price is reasonably competitive and the 1 17 quality meets departmental standards. 1 18 3. The department shall identify suppliers of Iowa 1 19 agricultural commodities and food processed from Iowa 1 20 agricultural commodities in order to comply with this section. 1 21 This section shall apply to a contractor or subcontractor who 1 22 is a party to a contract, if the contract provides for the 1 23 purchase of agricultural commodities on behalf of the 1 24 department. The department shall include the preference 1 25 required in this section in publications used to solicit bids 1 26 from suppliers of agricultural commodities and food. 1 27 Sec. 2. Section 29A.19, Code 1999, is amended to read as 1 28 follows: 1 29 29A.19 QUARTERMASTER. 1 30 1. A present or retired commissioned officer of the 1 31 national guard who has ten years' service in the Iowa national 1 32 guard or the Iowa air national guard and has attained the 1 33 grade of a field officer, shall be detailed to be the 1 34 quartermaster and property officer of the state, who shall 1 35 have charge of and be accountable for, under the adjutant 2 1 general, all state military property. The quartermaster shall 2 2 keep property returns and reports and give bond to the state 2 3 of Iowa as the governor may direct. 2 4 2. When purchasing agricultural commodities for processing 2 5 into food or processed food, the quartermaster shall comply 2 6 with the requirements for the purchase of agricultural 2 7 commodities and food in the same manner required by the 2 8 department of general services pursuant to section 18.21. 2 9 Sec. 3. Section 216B.3, Code Supplement 1999, is amended 2 10 by adding the following new subsection: 2 11 NEW SUBSECTION. 18. Comply with the requirements for the 2 12 purchase of agricultural commodities and food in the same 2 13 manner required by the department of general services pursuant 2 14 to section 18.21. 2 15 Sec. 4. Section 217.3, Code 1999, is amended by adding the 2 16 following new subsection: 2 17 NEW SUBSECTION. 9. Comply with the requirements for the 2 18 purchase of agricultural commodities and food in the same 2 19 manner required by the department of general services pursuant 2 20 to section 18.21. 2 21 Sec. 5. Section 260C.19B, Code 1999, is amended to read as 2 22 follows: 2 23 260C.19B PURCHASEOF BIODEGRADABLE HYDRAULIC FLUIDS2 24 PREFERENCES. 2 25 1. Hydraulic fluids purchased by or used under the 2 26 direction of the board of directors to provide services to a 2 27 merged area shall be purchased in compliance with the 2 28 preference requirements for purchasing biodegradable hydraulic 2 29 fluids as provided pursuant to section 18.22. 2 30 2. Agricultural commodities for processing into food or 2 31 processed food purchased under the direction of the board of 2 32 directors for a merged area shall comply with the requirements 2 33 established for the department of general services under 2 34 section 18.21. 2 35 Sec. 6. Section 262.9, Code Supplement 1999, is amended by 3 1 adding the following new subsection: 3 2 NEW SUBSECTION. 5A. Comply with the requirements for the 3 3 purchase of agricultural commodities and processed food in the 3 4 same manner required by the department of general services 3 5 pursuant to section 18.21. 3 6 Sec. 7. Section 307.21, Code Supplement 1999, is amended 3 7 by adding the following new subsection: 3 8 NEW SUBSECTION. 6A. Comply with the requirements for the 3 9 purchase of agricultural commodities and processed food in the 3 10 same manner required by the department of general services 3 11 pursuant to section 18.21. 3 12 Sec. 8. Section 904.312, unnumbered paragraph 2, Code 3 13 1999, is amended to read as follows: 3 14 The director shall, wheneverdo all of the following: 3 15 1. Whenever technically feasible, purchase and use 3 16 degradable loose foam packing material manufactured from grain 3 17 starches or other renewable resources, unless the cost of the 3 18 packing material is more than ten percent greater than the 3 19 cost of packing material made from nonrenewable resources. 3 20 For the purposes of this subsection, "packing material" means 3 21 material, other than an exterior packing shell, that is used 3 22 to stabilize, protect, cushion, or brace the contents of a 3 23 package. 3 24 2. Comply with the requirements for the purchase of 3 25 agricultural commodities and processed food in the same manner 3 26 required by the department of general services pursuant to 3 27 section 18.21. 3 28 EXPLANATION 3 29 This bill provides that when purchasing agricultural 3 30 commodities for processing into food, state agencies must 3 31 purchase Iowa agricultural commodities, and when purchasing 3 32 food, state agencies must purchase food that has been 3 33 processed from Iowa agricultural commodities. The bill 3 34 provides that this requirement applies only if the price is 3 35 reasonably competitive, sources for the agricultural 4 1 commodities or food are available, and the quality of the 4 2 agricultural commodities or food meets agency standards. The 4 3 bill requires state agencies that are involved in purchases to 4 4 identify suppliers of Iowa agricultural commodities and food 4 5 processed from Iowa agricultural commodities. The bill 4 6 applies to persons acting under contract with the state 4 7 agency. It also requires that the agency include the 4 8 preference in publications used to solicit bids from suppliers 4 9 of agricultural commodities and food. 4 10 The state agencies affected include the department of 4 11 general services, the Iowa national guard, the department for 4 12 the blind, the department of human services, community 4 13 colleges, the state board of regents, the state department of 4 14 transportation, and the department of corrections. 4 15 LSB 6245YH 78 4 16 da/cf/24
