  1  1    Section 1.  Section 256.39, subsection 8, Code 1999, is
  1  2 amended by striking the subsection.
  1  3    Sec. 2.  Section 256A.4, subsection 1, unnumbered paragraph
  1  4 1, Code 1999, is amended to read as follows:
  1  5    The board of directors of each school district may develop
  1  6 and offer a program which provides outreach and incentives for
  1  7 the voluntary participation of expectant parents and parents
  1  8 of children in the period of life from birth through age five,
  1  9 who reside within district boundaries, in educational family
  1 10 support experiences designed to assist parents in learning
  1 11 about the physical, mental, and emotional development of their
  1 12 children.  A district providing a family support program,
  1 13 which seeks additional funding under sections 294A.13 through
  1 14 294A.16, shall meet the requirements of this section and the
  1 15 program shall be subject to approval by the department of
  1 16 education.  A board may contract with another school district
  1 17 or public or private nonprofit agency for provision of the
  1 18 approved program or program site.
  1 19    Sec. 3.  Section 256C.3, unnumbered paragraph 2, Code
  1 20 Supplement 1999, is amended to read as follows:
  1 21    A family resource center shall coordinate services provided
  1 22 with existing federal, state, and local programs both to avoid
  1 23 duplication and to provide continuity of services.  A family
  1 24 resource center shall, if possible, be located in a school
  1 25 building or in an existing community facility.  Regardless of
  1 26 where the center is located, the school district shall be the
  1 27 primary decision-making body in any partnership established to
  1 28 create a family resource center.  The establishment of a
  1 29 family resource center is a comprehensive school
  1 30 transformation program under chapter 294A.
  1 31    Sec. 4.  Section 257.1, subsection 2, unnumbered paragraph
  1 32 2, Code Supplement 1999, is amended to read as follows:
  1 33    For the budget year commencing July 1, 1999, and for each
  1 34 succeeding budget year the regular program foundation base per
  1 35 pupil is eighty-seven and five-tenths percent of the regular
  2  1 program state cost per pupil.  For the budget year beginning
  2  2 July 1, 2000, this amount shall be increased by an additional
  2  3 amount determined pursuant to section 257.10, subsection 2,
  2  4 paragraphs "c" and "d".  For the budget year commencing July
  2  5 1, 1991, and for each succeeding budget year the special
  2  6 education support services foundation base is seventy-nine
  2  7 percent of the special education support services state cost
  2  8 per pupil.  The combined foundation base is the sum of the
  2  9 regular program foundation base and the special education
  2 10 support services foundation base.
  2 11    Sec. 5.  Section 257.10, subsection 2, Code Supplement
  2 12 1999, is amended by adding the following new paragraphs:
  2 13    NEW PARAGRAPH.  c.  For the budget year beginning July 1,
  2 14 2000, the regular program district cost per pupil determined
  2 15 pursuant to paragraph "a" for each school district shall be
  2 16 increased by an amount equivalent to the amount allocated for
  2 17 phase II and phase III pursuant to section 294A.25, subsection
  2 18 8, Code Supplement 1999, for the budget year beginning July 1,
  2 19 1999, adjusted as provided in paragraph "d", times the ratio
  2 20 of the budget enrollment for that school district divided by
  2 21 the combined budget enrollment for all school districts in the
  2 22 state.  Notwithstanding paragraph "b", district cost per pupil
  2 23 shall not be subject to a reduction if the district cost per
  2 24 pupil would not have exceeded one hundred five percent of the
  2 25 regular program state cost per pupil but for the increase
  2 26 received pursuant to this paragraph.  For purposes of
  2 27 determining the amount of a budget adjustment as defined in
  2 28 section 257.14, the increase received pursuant to this
  2 29 paragraph shall be subtracted from the school district's
  2 30 regular program district cost per pupil for the budget year
  2 31 beginning July 1, 2000, prior to determining the amount of the
  2 32 adjustment.
  2 33    NEW PARAGRAPH.  d.  For purposes of determining the amount
  2 34 of the increase to the district cost per pupil pursuant to
  2 35 paragraph "c", the amount allocated for phase II and phase III
  3  1 pursuant to section 294A.25, subsection 8, Code Supplement
  3  2 1999, for the budget year beginning July 1, 1999, shall be
  3  3 reduced by the amount of any appropriation from that
  3  4 allocation pursuant to that subsection applicable to the
  3  5 budget year beginning July 1, 1999, such that the increase to
  3  6 district cost per pupil shall reflect the actual amounts
  3  7 expended for phase II and phase III, not including any
  3  8 appropriation from that allocation for another purpose, prior
  3  9 to division by the combined budget enrollment.
  3 10    Sec. 6.  Section 258.17, subsection 4, Code 1999, is
  3 11 amended to read as follows:
  3 12    4.  Each workstart program shall include a written
  3 13 agreement by the school or school district with one or more
  3 14 businesses from the surrounding community to provide
  3 15 workplace-specific training and learning programs which are
  3 16 related to the skills needed to succeed in those occupational
  3 17 areas.  The proposed plan for implementation of the workstart
  3 18 program shall include a copy of the written agreement between
  3 19 the school or school district and the business or businesses
  3 20 and a business support component, which shall consist of
  3 21 financial or in-kind support, or both financial and in-kind
  3 22 support, from the businesses that have entered into the
  3 23 agreement with the school or school district.  The plan may
  3 24 provide for the utilization of phase III and other available
  3 25 school funds in the establishment of the program.  A workstart
  3 26 program is a comprehensive school transformation program under
  3 27 section 294A.14.
  3 28    Sec. 7.  Section 294A.1, Code 1999, is amended to read as
  3 29 follows:
  3 30    294A.1  EDUCATIONAL EXCELLENCE PROGRAM.
  3 31    The purpose of this chapter is to promote excellence in
  3 32 education.  In order to maintain and advance the educational
  3 33 excellence in the state of Iowa, this chapter establishes
  3 34 phase I of the Iowa educational excellence program devoted to
  3 35 the recruitment of quality teachers.  The program shall
  4  1 consist of three major phases addressing the following:
  4  2    1.  Phase I – The recruitment of quality teachers.
  4  3    2.  Phase II – The retention of quality teachers.
  4  4    3.  Phase III – The enhancement of the quality and
  4  5 effectiveness of teachers through the utilization of
  4  6 performance pay.
  4  7    Sec. 8.  Section 294A.3, unnumbered paragraph 2, Code 1999,
  4  8 is amended by striking the unnumbered paragraph.
  4  9    Sec. 9.  Section 294A.22, unnumbered paragraph 3, Code
  4 10 1999, is amended to read as follows:
  4 11    Payments made to a teacher by a school district or area
  4 12 education agency under this chapter are wages for the purposes
  4 13 of chapter 91A except for payments made under an approved
  4 14 phase III plan where a modified payment plan has either been
  4 15 mutually agreed upon by the board of directors and the
  4 16 certified bargaining representative for certificated employees
  4 17 or for a district that is not organized for collective
  4 18 bargaining purposes where a modified payment plan is adopted
  4 19 by the board.
  4 20    Sec. 10.  Section 294A.25, Code Supplement 1999, is amended
  4 21 by striking the section and inserting in lieu thereof the
  4 22 following:
  4 23    294A.25  APPROPRIATION.
  4 24    1.  For each fiscal year, there is appropriated from the
  4 25 general fund of the state to the department of education an
  4 26 amount equivalent to the amount allocated to phase I pursuant
  4 27 to section 294A.25, subsection 8, Code Supplement 1999, for
  4 28 the recruitment of quality teachers, plus additional amounts
  4 29 sufficient for distribution as provided in this section.
  4 30    2.  An amount shall be paid to the state board of regents
  4 31 sufficient for distribution to licensed classroom teachers at
  4 32 the Iowa braille and sight saving school and the Iowa school
  4 33 for the deaf for payments of minimum salary supplements for
  4 34 phase I based upon the average yearly enrollment at each
  4 35 school as determined by the state board of regents.
  5  1    3.  For each fiscal year, one hundred thousand dollars
  5  2 shall be paid to the department of education for distribution
  5  3 to the tribal council of the Sac and Fox Indian settlement
  5  4 located on land held in trust by the secretary of the interior
  5  5 of the United States.  Moneys allocated under this subsection
  5  6 shall be used for the purposes specified in section 256.30.
  5  7    4.  For each fiscal year, seventy-five thousand dollars
  5  8 shall be paid to support the ambassador to education program
  5  9 under section 256.45.
  5 10    5.  For each fiscal year, seventy thousand dollars shall be
  5 11 paid to the state board of regents for equal distribution to
  5 12 the Iowa braille and sight saving school and the Iowa state
  5 13 school for the deaf.
  5 14    Sec. 11.  Section 331.909, subsection 2, Code 1999, is
  5 15 amended to read as follows:
  5 16    2.  The activities of a multidisciplinary community
  5 17 services team shall not duplicate the activities of a
  5 18 multidisciplinary team for child abuse under section 235A.13,
  5 19 dependent adult abuse activities under section 235B.6, area
  5 20 education agency activities under section 294A.14, or child
  5 21 victim services provided under section 915.35.
  5 22    Sec. 12.  Sections 294A.8 through 294A.20 and section
  5 23 294A.23, Code 1999, are repealed.
  5 24    Sec. 13.  EFFECTIVE DATE.  This Act, being deemed of
  5 25 immediate importance, takes effect upon enactment.  
  5 26                           EXPLANATION
  5 27    This bill provides for additional state aid to school
  5 28 districts.  The bill provides that for the school budget year
  5 29 beginning July 1, 2000, the regular program foundation base
  5 30 per pupil, and the district cost per pupil, shall be increased
  5 31 by an amount equivalent to the amount allocated for phase II
  5 32 and phase III pursuant to Code section 294A.25, subsection 8,
  5 33 Code Supplement 1999, for the budget year beginning July 1,
  5 34 1999, multiplied by the ratio of the budget enrollment for the
  5 35 school district divided by the combined budget enrollment for
  6  1 all school districts in the state.  The bill provides that in
  6  2 determining the amount of this increase, the amount allocated
  6  3 for phase II and phase III pursuant to Code section 294A.25,
  6  4 subsection 8, Code Supplement 1999, for the budget year
  6  5 beginning July 1, 1999, shall be reduced by the amount of any
  6  6 appropriation from that allocation pursuant to that subsection
  6  7 applicable for that budget year, such that the increase to the
  6  8 district cost per pupil shall reflect the actual amounts
  6  9 expended for phase II and phase III, not including any
  6 10 appropriation from that allocation for another purpose, prior
  6 11 to multiplication by the ratio of the district's budget
  6 12 enrollment divided by the combined budget enrollment.
  6 13    The bill also provides that the increase in district cost
  6 14 per pupil shall not be counted for purposes of determining
  6 15 whether or not the regular program district cost of a school
  6 16 district exceeds 105 percent of the regular program state cost
  6 17 per pupil, which would otherwise result in a reduction in the
  6 18 district cost per pupil pursuant to Code section 257.10,
  6 19 subsection 2, paragraph "b".  The bill additionally provides
  6 20 that for purposes of determining the amount of a budget
  6 21 adjustment pursuant to Code section 257.14, the increase shall
  6 22 be subtracted from the school district's regular program
  6 23 district cost per pupil for the budget year beginning July 1,
  6 24 2000, prior to determining the amount of the adjustment.
  6 25    The bill provides for the repeal of phases II and III of
  6 26 the educational excellence program contained in Code chapter
  6 27 294A, and includes a number of conforming changes.  The bill
  6 28 provides for an appropriation for the fiscal year beginning
  6 29 July 1, 2000, and for each succeeding year, to the department
  6 30 of education of an amount equivalent to the amount allocated
  6 31 to phase I pursuant to section 294A.25, subsection 8, Code
  6 32 Supplement 1999, for the recruitment of quality teachers, plus
  6 33 additional amounts, sufficient to fund the standing
  6 34 appropriations previously funded from appropriations to phases
  6 35 I, II, and III pursuant to Code section 294A.25, subsection 1,
  7  1 Code Supplement 1999.
  7  2    The bill takes effect upon enactment.
