  1  1    Section 1.  Section 73.16, subsection 2, Code 1999, is
  1  2 amended to read as follows:
  1  3    2.  The director of each agency or department of state
  1  4 government having purchasing authority shall establish a
  1  5 procurement goal from certified targeted small businesses
  1  6 identified pursuant to section 10A.104, subsection 8, of at
  1  7 least ten percent of the value of anticipated procurements of
  1  8 goods and services, including construction, but not including
  1  9 utility services, each fiscal year nondiscrimination based on
  1 10 the age, race, creed, color, sex, national origin, religion,
  1 11 or disability of the owners of a targeted small business.  The
  1 12 director of each department and agency of state government
  1 13 shall cooperate with the director of the department of
  1 14 inspections and appeals, the director of the department of
  1 15 economic development, and the director of the department of
  1 16 management and do all acts necessary to carry out the
  1 17 provisions of this division.
  1 18    A community college, area education agency, or school
  1 19 district shall establish a procurement goal from certified
  1 20 targeted small businesses, identified pursuant to section
  1 21 10A.104, subsection 8, of at least ten percent of the value of
  1 22 anticipated procurements of goods and services including
  1 23 construction, but not including utility services, each fiscal
  1 24 year nondiscrimination based on the age, race, creed, color,
  1 25 sex, national origin, religion, or disability of the owners of
  1 26 a targeted small business.
  1 27    Of the total value of anticipated procurements of goods and
  1 28 services under this subsection, an additional goal shall be
  1 29 established to procure at least forty percent from minority-
  1 30 owned businesses, and forty percent from female-owned
  1 31 businesses.
  1 32    Sec. 2.  Section 73.17, Code 1999, is repealed.  
  1 33                           EXPLANATION
  1 34    This bill relates to the state agency procurement goals
  1 35 from targeted small businesses.  Currently, state agencies and
  2  1 departments are required to have a procurement goal from
  2  2 targeted small businesses of at least 10 percent of the value
  2  3 of anticipated procurements of goods and services.  The bill
  2  4 strikes the 10 percent goal and replaces it with a procurement
  2  5 goal of nondiscrimination based on the age, race, creed,
  2  6 color, sex, national origin, religion, or disability of the
  2  7 owners of a targeted small business.
  2  8    The bill repeals Code section 73.17 relating to the
  2  9 preliminary procedures for the targeted small business
  2 10 procurement goals which relate to the 10 percent goal.
