PAG LIN 1 1 Section 1. Section 724.22, subsection 7, Code 1999, is 1 2 amended to read as follows: 1 3 7. ACCESS TO LOADED FIREARMS BY CHILDREN RESTRICTED – 1 4 PENALTY. 1 5 a. It shall be unlawful for any person to store or leave a 1 6 loaded firearm which is not secured by a trigger lock 1 7 mechanism, placed in a securely locked box or container, or 1 8 placed in some other location which a reasonable person would 1 9 believe to be secure from a minor under the age offourteen1 10 eighteen years, if such person knows or has reason to believe 1 11 that a minor under the age offourteeneighteen years is 1 12 likely to gain access to the firearm without the lawful 1 13 permission of the minor's parent, guardian, or person having 1 14 charge of the minor, the minor lawfully gains access to the 1 15 firearm without the consent of the minor's parent, guardian, 1 16 or person having charge of the minor, and the minor exhibits 1 17 the firearm in a public place in an unlawful manner, or uses 1 18 the firearm unlawfully to cause injury or death to a person. 1 19 b. This subsection does not apply if the minor obtains the 1 20 firearm as a result of an unlawful entry by any person. 1 21 c. A violation of this subsection is punishable as a 1 22 serious misdemeanor. 1 23 EXPLANATION 1 24 This bill amends Code chapter 724, relating to restricted 1 25 access to firearms by minors. 1 26 The bill changes the penalties for unsafe storage of and 1 27 unlawful access to firearms by minors to include all minors 1 28 under the age of 18, rather than 14.
