  1  1    Section 1.  Section 411.15, Code 1999, is amended to read
  1  2 as follows:
  1  3    411.15  HOSPITALIZATION AND MEDICAL ATTENTION.
  1  4    Cities shall provide hospital, nursing, and medical
  1  5 attention for the members of the police and fire departments
  1  6 of the cities, when injured while in the performance of their
  1  7 duties as members of such department, and shall continue to
  1  8 also provide hospital, nursing, and medical attention for
  1  9 injuries or diseases incurred while in the performance of
  1 10 their duties for members receiving a retirement allowance
  1 11 under section 411.6, subsection 6.  Cities may provide the
  1 12 hospital, nursing, and medical attention required by this
  1 13 section through the purchase of insurance, by self-insuring
  1 14 the obligation, or through payment of moneys into a local
  1 15 government risk pool established for the purpose of covering
  1 16 the costs associated with the requirements of this section.
  1 17 The cost of providing the hospital, nursing, and medical
  1 18 attention required by this section shall be paid from moneys
  1 19 held in a trust and agency fund established pursuant to
  1 20 section 384.6, or out of the appropriation for the department
  1 21 to which the injured person belongs or belonged; provided that
  1 22 any amounts received by the injured person under the workers'
  1 23 compensation law of the state, or from any other source for
  1 24 such specific purposes, shall be deducted from the amount paid
  1 25 by the city under the provisions of this section.
  1 26    Sec. 2.  APPLICABILITY.  This Act is applicable to members
  1 27 who were retired for accidental disability on or after July 1,
  1 28 1980.  However, the requirement of this Act that cities
  1 29 provide hospital, nursing, and medical attention for members
  1 30 receiving a retirement allowance under section 411.6,
  1 31 subsection 6, only applies on or after the effective date of
  1 32 this Act.  
  1 33                           EXPLANATION
  1 34    This bill requires cities to provide hospital, nursing, and
  1 35 medical attention for members of the municipal fire and police
  2  1 retirement system receiving a retirement allowance under Code
  2  2 section 411.6, subsection 6.  The bill applies to members of
  2  3 the system who retired due to an accidental disability on or
  2  4 after July 1, 1980, but the requirement to provide this
  2  5 benefit only applies on or after the effective date of this
  2  6 bill.  Currently, cities are obligated to provide medical
  2  7 attention for members receiving a retirement allowance for an
  2  8 accidental disability only for injuries or diseases incurred
  2  9 while in the performance of the member's duties.
