  1  1    Section 1.  Section 321.218, subsection 1, Code Supplement
  1  2 1999, is amended to read as follows:
  1  3    1.  A person whose driver's license or operating privilege
  1  4 has been denied, canceled, suspended, or revoked as provided
  1  5 in this chapter or as provided in section 252J.8 or section
  1  6 901.5, subsection 10, and who operates a motor vehicle upon
  1  7 the highways of this state while the license or privilege is
  1  8 denied, canceled, suspended, or revoked, commits a simple
  1  9 serious misdemeanor.  In addition to any other penalties, the
  1 10 punishment imposed for a violation of this subsection shall
  1 11 include assessment of a fine of not less than two hundred
  1 12 fifty dollars nor more than one thousand five hundred dollars.
  1 13    Sec. 2.  Section 321A.32, subsection 1, Code Supplement
  1 14 1999, is amended to read as follows:
  1 15    1.  Any person whose license or registration or
  1 16 nonresident's operating privilege has been suspended, denied,
  1 17 or revoked under this chapter or continues to remain suspended
  1 18 or revoked under this chapter, and who, during such
  1 19 suspension, denial, or revocation, or during such continuing
  1 20 suspension or continuing revocation, drives any motor vehicle
  1 21 upon any highway or knowingly permits any motor vehicle owned
  1 22 by such person to be operated by another upon any highway,
  1 23 except as permitted under this chapter, shall be guilty of a
  1 24 simple serious misdemeanor.  In addition to any other
  1 25 penalties, the punishment imposed for a violation of this
  1 26 subsection shall include assessment of a fine of not less than
  1 27 two hundred fifty dollars nor more than one thousand five
  1 28 hundred dollars.  
  1 29                           EXPLANATION
  1 30    This bill changes the criminal penalty for driving while
  1 31 one's driver's license, operating privilege, or registration
  1 32 has been suspended, denied, canceled, or revoked.
  1 33    The amendments to Code sections 321.218 and 321A.32 change
  1 34 the criminal penalty for driving while suspended, denied,
  1 35 canceled or revoked from a simple misdemeanor to a serious
  2  1 misdemeanor.
  2  2    A serious misdemeanor is punishable by confinement for no
  2  3 more than one year and a fine of at least $250 but not more
  2  4 than $1,500.  A simple misdemeanor is punishable by
  2  5 confinement for no more than 30 days or a fine of at least $50
  2  6 but not more than $500 or by both.  The mandatory minimum fine
  2  7 under Code sections 321.218 and 321A.32 is $250.
