  1  1    Section 1.  NEW SECTION.  514C.19  SOCIAL ANXIETY DISORDER
  1  2 COVERAGE.
  1  3    1.  Notwithstanding the uniformity of treatment
  1  4 requirements of section 514C.6, a policy or contract providing
  1  5 for third-party payment or prepayment of health or medical
  1  6 expenses which provides coverage benefits for the treatment of
  1  7 mental illness shall provide coverage benefits for the
  1  8 treatment of social anxiety disorder.
  1  9    2.  For purposes of this section, "social anxiety disorder"
  1 10 means a condition that satisfies the criteria for generalized
  1 11 social phobia set forth in the most recent edition of the
  1 12 American psychiatric association's diagnostic and statistical
  1 13 manual of mental disorders, as such definitions may be amended
  1 14 from time to time.  The commissioner, by rule, shall define
  1 15 social anxiety disorder consistent with the manual, and may
  1 16 adopt the definition provided in the manual by reference.
  1 17    3.  a.  This section applies to the following classes of
  1 18 third-party payment provider contracts or policies delivered,
  1 19 issued for delivery, continued, or renewed in this state on or
  1 20 after July 1, 2000:
  1 21    (1)  Individual or group accident and sickness insurance
  1 22 providing coverage on an expense-incurred basis.
  1 23    (2)  An individual or group hospital or medical service
  1 24 contract issued pursuant to chapter 509, 514, or 514A.
  1 25    (3)  An individual or group health maintenance organization
  1 26 contract regulated under chapter 514B.
  1 27    (4)  Any other entity engaged in the business of insurance,
  1 28 risk transfer, or risk retention, which is subject to the
  1 29 jurisdiction of the commissioner.
  1 30    (5)  A plan established pursuant to chapter 509A for public
  1 31 employees.
  1 32    (6)  An organized delivery system licensed by the director
  1 33 of public health.
  1 34    b.  This section shall not apply to accident only,
  1 35 specified disease, short-term hospital or medical, hospital
  2  1 confinement indemnity, credit, dental, vision, Medicare
  2  2 supplement, long-term care, basic hospital and medical-
  2  3 surgical expense coverage as defined by the commissioner,
  2  4 disability income insurance coverage, coverage issued as a
  2  5 supplement to liability insurance, workers' compensation or
  2  6 similar insurance, or automobile medical payment insurance.  
  2  7                           EXPLANATION
  2  8    This bill creates new Code section 514C.19 and provides
  2  9 that a group policy or contract providing for third-party
  2 10 payment or prepayment of health or medical expenses which
  2 11 provides coverage benefits for the treatment of mental illness
  2 12 shall provide coverage benefits for the treatment of social
  2 13 anxiety.
  2 14    The bill defines "social anxiety disorder" as a condition
  2 15 that satisfies the criteria for generalized social phobia set
  2 16 forth in the most recent edition of the American psychiatric
  2 17 association's diagnostic and statistical manual of mental
  2 18 disorders, as such definitions may be amended from time to
  2 19 time.  The bill provides that the commissioner, by rule, shall
  2 20 define social anxiety disorder consistent with the manual, and
  2 21 may adopt the definition provided in such manual by reference.
  2 22    The bill provides that the new Code section created applies
  2 23 to third-party payment provider contracts or policies
  2 24 delivered, issued for delivery, continued, or renewed in this
  2 25 state on or after July 1, 2000.
