1 1 Section 1. NEW SECTION. 321.6A AUTOMATED ENFORCEMENT
1 2 SYSTEMS.
1 3 1. A local authority or the department shall not use an
1 4 automated enforcement system to detect violations of traffic
1 5 regulations on streets and highways under its jurisdiction.
1 6 2. For purposes of this section, "automated enforcement
1 7 system" means a system operated by a local authority or the
1 8 department that uses a machine to automatically detect a
1 9 violation of a traffic regulation and simultaneously record a
1 10 photograph of the vehicle used in committing the violation,
1 11 the operator of the vehicle, or the license plate of the
1 12 vehicle.
1 13 EXPLANATION
1 14 This bill prohibits local authorities and the state
1 15 department of transportation from using automated enforcement
1 16 systems to detect violations of traffic regulations.
1 17 For purposes of the bill, "automated enforcement system"
1 18 means a system operated by a local authority or the state
1 19 department of transportation that uses a machine to
1 20 automatically detect a violation of a traffic regulation and
1 21 simultaneously record a photograph of the vehicle used in
1 22 committing the violation, the operator of the vehicle, or the
1 23 license plate of the vehicle.
