PAG LIN 1 1 Section 1. Section 357H.1, unnumbered paragraph 1, Code 1 2 1999, is amended to read as follows: 1 3 The board of supervisors of a county withless than eleven1 4thousand five hundred residents but more than ten thousand1 5five hundred residents, based upon the 1990 certified federal1 6census, and witha private lake development shall designate an 1 7 area surrounding the lake, if it is an unincorporated area of 1 8 the county, a rural improvement zone upon receipt of a 1 9 petition pursuant to section 357H.2, and upon the board's 1 10 determination that the area is in need of improvements. For 1 11 purposes of this chapter, "improvements" means dredging, 1 12 installation of erosion control measures, land acquisition, 1 13 and related improvements, including soil conservation 1 14 practices, within or outside of the boundaries of the zone. 1 15 EXPLANATION 1 16 This bill strikes the population qualification of counties 1 17 with a private lake development whose board of supervisors is 1 18 required to designate an area surrounding the lake as a rural 1 19 improvement zone if the following criteria are met: 1 20 1. The area of the proposed zone is not within the 1 21 corporate limits of a city. 1 22 2. The board receives a petition from at least 25 percent 1 23 of the residents of the proposed zone who own property in the 1 24 proposed zone equal to at least 25 percent of the total 1 25 assessed value of the proposed zone. 1 26 3. The board determines that the area needs improvement. 1 27 Under current law, only a board of supervisors of a county 1 28 with a population between 10,500 and 11,500 (based on the 1990 1 29 census) with a private lake is eligible to designate a rural 1 30 improvement zone. 1 31 LSB 5014HH 78 1 32 tj/gg/8
