1 1 Section 1. Section 144A.3, subsection 2, paragraph a, Code
1 2 1999, is amended by adding the following new unnumbered
1 3 paragraph:
1 4 NEW UNNUMBERED PARAGRAPH. Notwithstanding any provision of
1 5 this paragraph "a" to the contrary, a chaplain or other
1 6 religious leader or a social worker licensed pursuant to
1 7 chapter 154C, who is officially associated with or employed by
1 8 a health care provider, may act as a witness for a
1 9 declaration.
1 10 Sec. 2. Section 144B.3, subsection 2, Code 1999, is
1 11 amended by adding the following new unnumbered paragraph:
1 12 NEW UNNUMBERED PARAGRAPH. Notwithstanding any provision of
1 13 this subsection to the contrary, a chaplain or other religious
1 14 leader or a social worker licensed pursuant to chapter 154C,
1 15 who is officially associated with or employed by a health care
1 16 provider, may act as a witness for a durable power of attorney
1 17 for health care.
1 18 EXPLANATION
1 19 This bill provides that a chaplain or other religious
1 20 leader or a licensed social worker, who is officially
1 21 associated with or employed by a health care provider, may act
1 22 as a witness to a declaration executed under the life-
1 23 sustaining procedures law or to a durable power of attorney
1 24 for health care document.
