  1  4 RELATING TO DRAWING THE SAC AND FOX INDIAN SETTLEMENT
  1  5    PRECINCT IN TAMA COUNTY.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1  8 
  1  9    Section 1.  Section 49.3, subsection 3, Code 1999, is
  1 10 amended to read as follows:
  1 11    3.  Precincts Except as provided in section 49.4,
  1 12 subsection 3, precincts established after July 1, 1994, shall
  1 13 be composed of contiguous territory within a single county.
  1 14 The boundaries of all precincts shall follow the boundaries of
  1 15 areas for which official population figures are available from
  1 16 the most recent federal decennial census.
  1 17    Sec. 2.  Section 49.4, subsection 3, Code 1999, is amended
  1 18 to read as follows:
  1 19    3.  Notwithstanding any other provision of this chapter,
  1 20 Indian settlement land held in trust by the secretary of the
  1 21 interior of the United States for the Sac and Fox tribe of the
  1 22 Mississippi in Iowa and its trust land contiguous to the
  1 23 Indian settlement lying in Tama, Toledo and Indian Village
  1 24 townships of Tama county shall be an election precinct, and
  1 25 the.  The polling place of that precinct shall be located in
  1 26 the structure commonly called the Indian school located in
  1 27 section 19, township 83 north, range 15 west, or on the Indian
  1 28 settlement in such a structure as designated by the election
  1 29 commissioner of Tama county.
  1 30    The Indian settlement precinct shall be redrawn to include
  1 31 land contiguous to the Indian settlement when such land is
  1 32 purchased by the settlement and added to the Indian settlement
  1 33 land held in trust by the secretary of the interior of the
  1 34 United States.  Upon recording of the deed transferring the
  1 35 land to the United States in trust, the county recorder shall
  2  1 notify the county commissioner of that fact.  If the
  2  2 commissioner is notified more than seventy days before the
  2  3 next scheduled election, the commissioner shall redraw the
  2  4 precinct for that election.  The commissioner shall notify the
  2  5 board of supervisors of the redrawn precinct boundaries and
  2  6 shall certify the redrawn boundaries to the state
  2  7 commissioner.  Land completely surrounded by the boundaries of
  2  8 the Indian settlement precinct, but not included in the
  2  9 settlement precinct, shall be included in the precinct in
  2 10 which such land was located prior to redrawing of the Indian
  2 11 settlement precinct.  The commissioner shall notify registered
  2 12 voters in each of the redrawn precincts of the change in the
  2 13 precincts and the proper polling place for those affected
  2 14 voters.
  2 15    Sec. 3.  Section 49.8, Code 1999, is amended by adding the
  2 16 following new subsection:
  2 17    NEW SUBSECTION.  7.  When territory contiguous to the
  2 18 Indian settlement is added to the Indian settlement land held
  2 19 in trust by the secretary of the interior of the United
  2 20 States.
