  1  1    Section 1.  COLLEGE STUDENT AID COMMISSION.  There is
  1  2 appropriated from the general fund of the state to the college
  1  3 student aid commission for the fiscal year beginning July 1,
  1  4 1999, and ending June 30, 2000, the following amount, or so
  1  5 much thereof as is necessary, to be used for the purpose
  1  6 designated:
  1  7    For the access education program as established in section
  1  8 261.98:  
  1  9 .................................................. $    150,000
  1 10    Sec. 2.  Section 261.92, Code 1999, is amended by adding
  1 11 the following new subsection:
  1 12    NEW SUBSECTION.  6A.  "Person with a disability" means a
  1 13 person who is considered to be a person with a disability
  1 14 under the disability criteria specified in Title II or Title
  1 15 XVI of the federal Social Security Act or who has a physical
  1 16 or mental illness or condition which, in the expected natural
  1 17 course of the illness or condition, to a reasonable degree of
  1 18 medical certainty, is expected to continue for an
  1 19 uninterrupted period of twelve months or more and
  1 20 substantially impairs the person's ability to provide for the
  1 21 person's care or custody.
  1 22    Sec. 3.  NEW SECTION.  261.98  ACCESS EDUCATION GRANT
  1 23 PROGRAM.
  1 24    1.  An access education grant program is established within
  1 25 the Iowa grant program administered by the commission.  The
  1 26 provisions of sections 261.92 and 261.94 through 261.97 shall
  1 27 apply to the access education grant program except as follows:
  1 28    a.  A grant may be awarded to a person with a disability
  1 29 who is a resident of Iowa, is admitted and in attendance as a
  1 30 full-time or part-time resident student at an accredited
  1 31 higher education institution, and who establishes financial
  1 32 need.  Grants awarded in accordance with this section shall be
  1 33 distributed in the same manner as provided in section 261.93.
  1 34    b.  Notwithstanding section 261.95, subsection 1, the
  1 35 amount of a grant to a qualified full-time student for an
  2  1 academic year shall be the lesser of the student's financial
  2  2 need for that academic year or up to two thousand dollars.
  2  3    2.  The provisions of section 261.93A shall not apply to
  2  4 funds appropriated for purposes of this section.  
  2  5                           EXPLANATION
  2  6    This bill establishes the access education grant program
  2  7 within the Iowa grant program administered by the college
  2  8 student aid commission and appropriates $150,000 from the
  2  9 general fund of the state for FY 1999-2000 for purposes of the
  2 10 program.
  2 11    The provisions of the Iowa grant program apply to the
  2 12 access education program except that in addition to the
  2 13 eligibility requirements for the Iowa grant program, an
  2 14 individual must be a person with a disability to qualify for
  2 15 an access education grant.  The bill defines "person with a
  2 16 disability" to mean a person who is considered to be a person
  2 17 with a disability under the disability criteria specified in
  2 18 Title II or Title XVI of the federal Social Security Act or
  2 19 who has a physical or mental illness or condition which, in
  2 20 the expected natural course of the illness or condition, to a
  2 21 reasonable degree of medical certainty, is expected to
  2 22 continue for a continuous period of 12 months or more and
  2 23 substantially impairs the person's ability to provide for the
  2 24 person's care or custody.
  2 25    The maximum grant amount for a full-time student under the
  2 26 access education grant program is $2,000, while the maximum
  2 27 amount for an Iowa grant program award is $1,000.
  2 28    The Code requires that moneys appropriated for the Iowa
  2 29 grant program be distributed to community colleges, accredited
  2 30 private institutions, and regents universities according to
  2 31 set percentages.  Moneys appropriated for purposes of the
  2 32 access education grant program are not to be distributed using
  2 33 these percentages.
