  1  1    Section 1.  Section 172A.2, Code 1999, is amended to read
  1  2 as follows:
  1  3    172A.2  LICENSE REQUIRED.
  1  4    1.  No A person shall not act as a dealer or broker without
  1  5 first being licensed.  No A person shall not act for any a
  1  6 dealer or broker as an agent unless such all of the following
  1  7 apply:
  1  8    a.  The dealer or broker is licensed, has designated such.
  1  9    b.  The dealer or broker designates the agent to act in the
  1 10 dealer's or broker's behalf, and has notified.
  1 11    c.  The dealer or broker notifies the secretary of the
  1 12 designation of the agent in the dealer's or broker's
  1 13 application for license or has given provides official notice
  1 14 in writing of the appointment of the agent and to the
  1 15 secretary has issued to the agent.
  1 16    d.  The secretary issues the person an agent's license.
  1 17    2.  A dealer or broker shall be accountable and responsible
  1 18 for contracts made by an agent in the course of the agent's
  1 19 employment.
  1 20    3.  The license of an agent whose employment by the dealer
  1 21 or broker is terminated shall be void on the date written
  1 22 notice of termination is received by the secretary.  The
  1 23 license of a dealer, broker, or agent, unless revoked, shall
  1 24 expire on the last day of June following the date of issue.
  1 25    4.  The annual fee for the license of a dealer or broker is
  1 26 fifty one thousand dollars.  The annual fee for an agent's
  1 27 license is ten dollars.
  1 28    5.  No The secretary shall not issue a license to a person
  1 29 may be issued a license if that person under this chapter who
  1 30 previously has had a license revoked, or previously was issued
  1 31 a license and the secretary suspended that license, unless the
  1 32 order of suspension or revocation or suspension is thereafter
  1 33 terminated by the secretary.  
  1 34                           EXPLANATION 
  1 35    This bill amends Code section 172A.2, which provides that
  2  1 packers (referred to as dealers or brokers) and agents must be
  2  2 licensed by the secretary of agriculture.  The annual license
  2  3 fee required for dealers and brokers is $50.  The bill
  2  4 increases the fee to $1,000.  The bill also amends provisions
  2  5 in the section to enhance its readability.  A person who acts
  2  6 as a dealer or broker without a license as required in Code
  2  7 chapter 172B is guilty of a serious misdemeanor.
