PAG LIN 1 1 Section 1. Section 483A.1, subsection 1, paragraphs b and 1 2 d, Code 1999, are amended by striking the paragraphs. 1 3 Sec. 2. Section 483A.24, subsection 14, Code 1999, is 1 4 amended to read as follows: 1 5 14. The department shall issue without chargea specialan 1 6 annual fishing or combined hunting and fishing license to 1 7 residents of this state who have permanent disabilities and 1 8 whose income falls below the federal poverty guidelines as 1 9 published by the United States department of health and human 1 10 servicesor. The department shall also issue without charge a 1 11 lifetime combined hunting and fishing license to residents of 1 12 this state who are sixty-five years of age or olderand whose1 13income falls below the federal poverty guidelines as published1 14by the United States department of health and human services. 1 15 The commission shall provide for, by rule, an application to 1 16 be used by an applicant requesting aspeciallicense under 1 17 this subsection. The commission shall require proof of age, 1 18 income, and proof of permanent disability, as applicable. 1 19 Sec. 3. REFUND FOR LIFETIME HUNTING AND FISHING LICENSES. 1 20 A person who was issued a lifetime fishing license or lifetime 1 21 hunting license, or both licenses on or after December 15, 1 22 1998, pursuant to section 483A.1, subsection 1, paragraph "b" 1 23 or "d", for a fee of fifty dollars and fifty cents is entitled 1 24 to a refund of fifty dollars and fifty cents for each lifetime 1 25 hunting license or each lifetime fishing license purchased. 1 26 The department shall notify each licensee by mail at the 1 27 address listed on the license that a refund may be requested 1 28 before December 1, 1999. After November 30, 1999, a refund 1 29 request authorized pursuant to this section shall not be 1 30 accepted and a refund shall not be paid. The refunds shall be 1 31 paid from the state fish and game conservation fund. 1 32 Sec. 4. EFFECTIVE DATE RETROACTIVE APPLICABILITY. 1 33 1. This Act, being deemed of immediate importance, takes 1 34 effect upon enactment. 1 35 2. Section 3 of this Act is retroactive to December 15, 2 1 1998, and applies to any lifetime fish license or lifetime 2 2 hunting license issued by the department of natural resources 2 3 pursuant to section 483A.1, subsection 1, paragraph "b" or 2 4 "d", from December 15, 1998, until the effective date of this 2 5 Act. 2 6 EXPLANATION 2 7 This bill requires the department of natural resources to 2 8 issue without charge a lifetime combined hunting and fishing 2 9 license to residents who are 65 years of age or older. 2 10 The bill authorizes a full refund of $50.50 for lifetime 2 11 hunting or fishing licenses issued on or after December 15, 2 12 1998. The department of natural resources shall notify each 2 13 lifetime licensee of the refund by mail to the address listed 2 14 on the license. The refund must be requested before December 2 15 1, 1999. The refunds are to be made from the state fish and 2 16 game conservation fund. 2 17 The bill is effective upon enactment.
