PAG LIN 1 1 Section 1. NEW SECTION. 261.21A TUITION AND FEES 1 2 EXEMPTION FOR PERSONS WHO RECEIVED FOSTER CARE. 1 3 1. For the purposes of this section unless the context 1 4 otherwise requires, "eligible student" means an individual who 1 5 meets both of the following conditions: 1 6 a. The student was subject to a court order under chapter 1 7 232, division III or IV, which transferred the custody of the 1 8 student to the department of human services and the student 1 9 was placed in foster care or another out-of-home placement at 1 10 any of the following times in the student's life: 1 11 (1) The day before the student's eighteenth birthday. 1 12 (2) The day of the student's fourteenth birthday, if the 1 13 student was eligible for adoption on or after that date. 1 14 (3) The day on which the student graduated from high 1 15 school or received the equivalent of a high school diploma. 1 16 b. The student enrolls in an undergraduate course of study 1 17 at a community college as defined in section 260C.2, or an 1 18 institution of higher learning under the control of the state 1 19 board of regents on or before the third anniversary of the 1 20 date the student was discharged from foster care, graduated 1 21 from high school, or received the equivalent of a high school 1 22 diploma. 1 23 2. An eligible student is exempt from payment of 1 24 undergraduate tuition and mandatory fees at a community 1 25 college as defined in section 260C.2, or an institution of 1 26 higher learning under the control of the state board of 1 27 regents. 1 28 EXPLANATION 1 29 This bill provides an exemption from the tuition and fees 1 30 charged by regents institutions and community colleges for 1 31 certain persons who were placed in foster care or another out- 1 32 of-home placement. 1 33 New Code section 261.21A would include the exemption as 1 34 part of the Code's college student aid commission chapter. 1 35 Eligibility is limited to students who were in the custody of 2 1 the department of human services under a child or family in 2 2 need of assistance court order and placed in foster care on 2 3 the day prior to their 18th birthday, on the day of their 14th 2 4 birthday if eligible for adoption, or on the day of high 2 5 school graduation or the receipt of an equivalency diploma. 2 6 The student must be enrolled in an undergraduate course of 2 7 study at a community college or regents institution on or 2 8 within three years of the date of discharge from foster care, 2 9 high school graduation, or receipt of the equivalent of a high 2 10 school diploma. 2 11 LSB 2462YH 78 2 12 jp/sc/14
