1 1 Section 1. Section 91C.8, Code 1999, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 10. A contractor shall not be subject to
1 4 the imposition of an administrative penalty for failure to be
1 5 registered if the contractor had previously been registered
1 6 and the labor commissioner failed to notify the contractor
1 7 concerning the expiration date of the contractor's
1 8 registration. The labor commissioner shall provide the
1 9 contractor notice no later than thirty days prior to, and
1 10 thirty days subsequent to, the expiration date of the
1 11 contractor's registration.
1 12 EXPLANATION
1 13 This bill provides that the labor commissioner shall not
1 14 impose an administrative penalty on a contractor for failure
1 15 to be registered if the commissioner failed to notify the
1 16 contractor concerning the expiration date of the registration.
1 17 The bill requires that notice be given no later than 30 days
1 18 before, and 30 days after, the date the registration is to
1 19 expire.
