  1  4 EXTENDING THE DEADLINE FOR CLOSING AGRICULTURAL DRAINAGE WELLS
  1  5    AND MAKING PENALTIES APPLICABLE.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 455I.3, subsection 1, Code 1999, is
  1 10 amended to read as follows:
  1 11    1.  Not later than December 31, 1999 2001, the owner of
  1 12 land which is within a designated agricultural drainage well
  1 13 area shall close each agricultural drainage well located on
  1 14 the land.  The owner shall close the agricultural drainage
  1 15 well in a manner using materials and according to
  1 16 specifications required by rules which shall be adopted by the
  1 17 department in consultation with the division.  The department
  1 18 may provide different closing requirements based on
  1 19 classifications established by the department.  However, the
  1 20 department's requirements shall ensure that an agricultural
  1 21 drainage well is closed by using sealing materials such as
  1 22 bentonite to permanently seal the agricultural drainage well
  1 23 from contamination by surface or subsurface water drainage.
