PAG LIN 1 1 Section 1. NEW SECTION. 905A.1 LOCAL CORRECTIONS 1 2 INFRASTRUCTURE REVOLVING FUND. 1 3 1. A local corrections infrastructure revolving fund is 1 4 created in the office of the treasurer of state to provide 1 5 grants, loans, or loan guarantees to eligible recipients for 1 6 the purposes provided in this section. The fund is under the 1 7 authority of the division of criminal and juvenile justice 1 8 planning of the department of human rights. The division 1 9 shall adopt rules pursuant to chapter 17A as necessary to 1 10 administer the revolving fund and to establish criteria for 1 11 providing grants, loans, or loan guarantees from the fund. In 1 12 establishing criteria, the division shall give preference to 1 13 cities or counties willing to provide a local match for moneys 1 14 provided from the revolving fund. Notwithstanding section 1 15 8.33, moneys in the fund at the end of a fiscal year shall not 1 16 revert to any other fund or to the general fund of the state 1 17 but shall remain in the revolving fund. Notwithstanding 1 18 section 12C.7, subsection 2, interest or earnings on moneys in 1 19 the fund shall be credited to the fund. The fund shall 1 20 consist of all appropriations, grants, or gifts received by 1 21 the division specifically for use as provided by this section 1 22 and all repayments of loans or grants made under this section. 1 23 2. A grant, loan, or loan guarantee authorized by this 1 24 section shall be utilized for any or all of the following 1 25 projects: 1 26 a. A county jail. 1 27 b. A regional or multicounty jail. 1 28 c. A county juvenile detention or shelter care home, 1 29 including retirement of outstanding debt for such a home. 1 30 d. A regional or multicounty juvenile detention or shelter 1 31 care home. 1 32 3. For purposes of this section, "eligible recipients" 1 33 means a city or county which expends funds for incarceration 1 34 or supervision of individuals charged with or convicted of a 1 35 felony, an aggravated misdemeanor, or a serious misdemeanor, 2 1 or accused of or found to have committed a delinquent act or 2 2 one or more cities or counties as described in this subsection 2 3 within a judicial election district as described in section 2 4 602.6109. 2 5 EXPLANATION 2 6 This bill creates a local corrections infrastructure 2 7 revolving fund in the treasurer of state's office under the 2 8 control of the division of criminal and juvenile justice 2 9 planning of the department of human rights. The bill provides 2 10 that the division establish rules governing the operation of 2 11 the fund, including criteria for providing disbursements from 2 12 the fund to eligible cities and counties. The bill defines an 2 13 eligible recipient of moneys from the fund as any city or 2 14 county that incarcerates individuals charged with a felony, 2 15 aggravated misdemeanor, or serious misdemeanor or a delinquent 2 16 act. The bill restricts the use of moneys from the fund to 2 17 projects for a county jail, a regional jail, a county juvenile 2 18 detention or shelter care home, or a regional juvenile 2 19 detention or shelter care home. 2 20 LSB 1915HH 78 2 21 ec/gg/8
