1 1 Section 1. Section 97B.52A, subsection 1, paragraph b,
1 2 Code 1999, is amended to read as follows:
1 3 b. For a member whose first month of entitlement is July
1 4 1998 or later, the member does not return to any employment,
1 5 except employment as an elected official, with a covered
1 6 employer until the member has qualified for no fewer than four
1 7 calendar months of retirement benefits. For purposes of this
1 8 paragraph, "elected official" means a person elected to a
1 9 public office, as defined in section 56.2, but does not mean a
1 10 member of the general assembly or a statewide elected
1 11 official.
1 12 EXPLANATION
1 13 This bill provides that a member of the Iowa public
1 14 employees' retirement system (IPERS) may retire and receive
1 15 retirement benefits even if the person remains in employment
1 16 or returns to employment within four months with a covered
1 17 employer, as an elected official. Under current law, IPERS
1 18 members who retire must not return to any employment with an
1 19 employer covered under IPERS for four months or else the
1 20 member is not eligible to receive retirement benefits. The
1 21 bill defines elected official as a person elected to any
1 22 county, city, or school office but excludes those persons
1 23 elected to the general assembly or to a statewide office.
