  1  1    Section 1.  Section 481A.48, unnumbered paragraph 2, Code
  1  2 1999, is amended to read as follows:
  1  3    The commission may adopt rules for the taking and
  1  4 possession of migratory birds which are subject to the federal
  1  5 "Migratory Bird Treaty Act" and "Migratory Bird Stamp Hunting
  1  6 Act" during the time and in the manner permitted under those
  1  7 federal Acts.  The commission shall not adopt a rule for the
  1  8 taking or possession of a migratory bird for which an open
  1  9 season is not authorized by another paragraph of this section.  
  1 10                           EXPLANATION 
  1 11    This bill removes a provision which restricts the natural
  1 12 resource commission from adopting a rule for the taking of a
  1 13 migratory bird authorized pursuant to federal law if an open
  1 14 season for the migratory bird is not otherwise authorized by
  1 15 state law.
