  1  1    Section 1.  NEW SECTION.  600.16C  SUBSEQUENT MEDICAL AND
  1  2 SOCIAL INFORMATION.
  1  3    1.  The biological parent of an adopted child shall provide
  1  4 updated family medical and social history information for
  1  5 placement in the adoption record of the adopted child as
  1  6 described in section 600A.4, subsection 2, paragraph "f", on
  1  7 an ongoing basis and at least once every five years following
  1  8 entry of the final adoption decree.
  1  9    2.  The updated information is subject to the limitations
  1 10 on availability of information and the penalties provided for
  1 11 violation of the law pursuant to sections 600.16 and 600.16A.
  1 12    Sec. 2.  Section 600A.4, subsection 2, paragraph f,
  1 13 unnumbered paragraph 2, Code 1999, is amended to read as
  1 14 follows:
  1 15    A biological parent may also shall provide ongoing
  1 16 information to the adoptive parents, as additional medical or
  1 17 social history information becomes known, and at least once
  1 18 every five years following entry of the final adoption decree,
  1 19 by providing information to the clerk of court, the department
  1 20 of human services, or the agency which made the placement, and
  1 21 may provide the current address of the biological parent.  The
  1 22 clerk of court, the department of human services, or the
  1 23 agency which made the placement shall place the information in
  1 24 the adopted child's file and shall transmit the information to
  1 25 the adoptive parents if the address of the adoptive parents is
  1 26 known.  
  1 27                           EXPLANATION 
  1 28    This bill requires the biological parent of an adopted
  1 29 child to provide family social and medical information to be
  1 30 included in the adoption record of the child and provided to
  1 31 the adoptive parent if the address of the adoptive parent is
  1 32 known, on an ongoing basis and at least once every five years
  1 33 following the entry of the final adoption decree.  The
  1 34 information is to be provided to the clerk of court, the
  1 35 department of human services, or the agency which made the
  2  1 placement.  The department of human services is to provide the
  2  2 forms for the collection of this information.  The existing
  2  3 limitations on availability of the information and the
  2  4 existing penalties for releasing the information in violation
  2  5 of the law are applicable.  The penalties for release of the
  2  6 information in violation of the law are generally a simple
  2  7 misdemeanor for a first offense, a serious misdemeanor for a
  2  8 second offense, and an aggravated misdemeanor for a third or
  2  9 subsequent offense.
